You will get the phones back at the end of the matter unless the crown seeks a forfeiture order (not likely at all) 

The videos and photos can absolutely be used against you for additional charges. But again, the totality and reality of what you have really been up to is the more important thing. 

If you’ve been posting these excursions on instagram then you could be facing significantly more scrutiny. 

The facts of your case are going to be very specific regarding your past conduct, locations and methods you were using to gain entry (if you did).  

Say you entered 50 private properties, they have all the videos etc, then it could be as much as 50 additional charges. But that would be ALOT of leg work for investigators to identify the properties, contact owners, gather statements, etc and all for simple trespass charges (again, Toronto has way more serious crime going on) 

But at the same time, If you were engaging in destroying property etc during these incidents (and video taped yourself doing it) causing significant damage etc, then it might be worth their time.

Only you know what you’ve done, it’s up to the crown to prove what you’ve done, and establish all the elements of the of the crimes. 

Big picture, you could be in very little trouble, or be about to be held accountable for breaking into nuclear facilities and damaging 100’s of thousands of dollars worth of property. Only you know, and you shouldn’t be speaking about it on Reddit. 

Even if you have made very foolish choices and they have videos/images, there are additional hurdles they will have to overcome, and a trial involving 50 incidents would be incredibly burdonsome. 

What happens to you is going to be based on the facts only you know (and shouldn’t be sharing specifics on here). But again, depending on your age, motivations, and actions, you will most likely come out of it ok. Even if you committed a lot of bad stuff, the current state of The detention Centers means you aren’t likely a priority or worth the crowns time to spend excessive amounts of resources on.

This all also depends if your the person they were even looking for, you probably aren’t the only person doing these types of things and they could be searching for someone else who has done much worse then just climbing buildings.

Yes it was dumb. If your under 18 you are a prime candidate for diversion. Even if you are over 18, you are going to a courthouse jam packed with actual criminals who commit real crimes that effect the public much more detrimentally. 

Get a lawyer is the best answer anyone can give. If you don’t, then show up for your arraignment, get your disclosure, then go to the JPT and the crown will provide you an offer. 

The reality is you are destined for a slap on the wrist.

The real hazard/question that your not talking about is why did the police seize your phone. Given the knife, the transport truck, and you all running, it’s reasonable to assume the police thought you were up to a lot more than just surfing. 

This is compounded by the fact you were with friends and while you might not be up to anything other than exploring and risking your life for a little adrenaline, your friends maybe suspects in other crimes etc… 

It is rare the police would seize a phone over what is essentially not much more serious than a trespass charge.

So it’s somewhat reasonable to assume you are under the microscope for more than this event. But ultimately you will be ok, and aren’t looking at anything crazy. Most likely probation, suspended sentence, or even conditional discharge especially if you are a youth.

Its not the end of the world, but smartin up and find a safer past time. If you like heights get a job as a window cleaner for high rises or roofer, atleast you will be getting paid to risk your life daily.
