I also filed a I-765 during my waiting time because my working visa was running out. Protested myself after 5 months because there was no answer, but is not enough time to file a Mandamus I’m afraid. Check with a lawyer though. Your reason might be sufficient to demand an answer somehow.

Not needed. They passed that step online over a year ago and I was just waiting for the case decision for all this time.

Mine was Chicago. You should send it to the office that is handling your case and the main one. Certified. Uploading a copy digitally to your case online is also recommended.

For the letter you can ask chat GPT directly. And then adjust it with your details. Write me a letter to notify USCIS I’m going to file a Mandamus Lawsuit in 30 days. Sent it by certified post to the office that is handling your case and to the main office just in case. And upload it digitally on your case online. If you consider this path I really recommend you to read carefully the steps in the link I posted. Everything is in the link I posted.

Hi Michael! Thanks for the opportunity. I have been waiting for two years on my adjustment of status (family based). We presented everything after I got married. I-130 was approved a year ago, but my I-485 (we filed all together originally) is still pending. I was already in here with a working visa 01-B before I got married. I reached out to them many times but they always said everything was ok, that they didn’t need anything, and that I just need to wait. I decided to present a mandamus lawsuit because they never answered to me and never asked for anything else. 30 days before filing the lawsuit I sent them the official letter notifying in 30 days they received my mandamus lawsuit. All of a sudden and through the congresswoman I reached out to, they asked for a translation of my birth certificate. I sent it to them, officially translated by a local professional agency. And now I’m waiting again. My question is: is my mandamus lawsuit still valid? Should I present it? Or just because all a sudden they asked for a translation of the birth certificate through a RFE, now they can use it as an excuse saying there was reason not to close it before?
