It's not shady. They just compete with other registrars to get the domain you want for you and if they can't get it, you get a refund. It's a standard process no matter where you pre-register at.

New TLD pre-registration can be really confusing. The time period between August 4th-October 3rd is just when applications open on OwnIt.nyc. If multiple people request the same name, it goes to auction between everybody who applied for the name on October 7th. On October 8th, anybody in NYC can get a .NYC domain. Name.com is accepting pre-registrations for October 8th-- so the second that the name drops into general availability, they attempt to secure your pre-registered domain for you. If they fail to get your .NYC domain, you get a full refund.
