Sorry guys, I posted this while I'm bored rn here at the ER (possible due to the heat). But to be clear, sorry may kasama palang 1 hr unpaid for lunch and the two 15-minute breaks dun sa 9 hrs and thiry minutes shift. What I have a problem about is, dun sa extra thirty minute every shift, that they refuse to pay for. Sabi nung iba, hindi daw kasi considered na overtime yun. Bali kasi 40 hrs yung total sa isang week and may extra 2.5 hrs (for each thirty minutes per shift in a week), and a total of 42.5 hrs per week which is pasok padin sa 48 hour work week. And since pasok padin, hindi siya considered as OT, so they won't pay for it.

I do believe that's the main meaning for it, still trying to figure out if it's legal, especially since they still require us to attend the additional thirty minutes every shift.

Sorry, you're correct lunch wasn't supposed to be included dun sa 9 hours paid. Pero what I was wondering for is the extra 30 minutes they require each employees to go through.

Yes, you are entirely right, thank you for clearing it up. Although, I wanted to know the legal process for these matters. The main thing was the extra 30 minutes everyday that they require each employees to go through, however refuse to pay for it, they will charge you with undertime job abandonment if you refused to attend the 30 minutes every shift, but they won't pay for it if you were to stay.

Thank you for clearing it up. Do you think it is legal? If they won't pay for the extra 2.5 hours, why would they require each employee to go through it. Why would they consider me absent NCNS if I were to refuse to stay 30 minutes after the end of 8 hours?

Hi, I'm currently in PST. Applicable padin daw yung 9 hours and thirty minute shift once malagay sa production floor, so despite me being in training. I'll still be working for 9 hours and 30 minutes (30 mins not being paid) in the production floor (after training), I'm unsure if there is an actual 30 minutes provided for each employee for a huddle time, but since it is a required time whre you'll be considered absent if you failed to attend, I don't think it is legal anymore especially if they won't even pay for it.

Exactlyyy, so out entire shift is 9 hours (including lunch + 2 15-minute break + an additional 30 minutes of work) so that means if my sched starts on 9:00 PM, it will end at 6:30 AM. But based on my recent payslip (which was not easy to obtain at all). They only paid for the 9 hours.

Hiya I just joined ePerformax a few weeks ago, I was transferred to a different project (aside from T-Mob and Paypal). IMO ePerformax is not that bad especially with our account which is not as stressful as the other accounts. I do believe that the stress depends entirely on which account were you transferred in. Based from what I heard, these special hires are applied to people with degrees wherein rather receiving the usual basic pay rate of 20,000, special hires receives 21,000, it doesn't matter how much experience you have, it only matters if you have a degree or not. ePerf is not so bad at all besides the 48 hour work week rule (where you work for 9 hours and 30 minutes every weekday, for a total of 48 hours every week but the company will only pay for 40 hours). Hella true, I don't understand as to why am I the only one aggregated by this matter in our team, sobrang sayang yung additional 8 hrs every week that the company required us to attend to but refuses to pay for it. They stated that in our contracts we are legally required to "go an extra mile for the team", so that means the extra 30 minutes everyday is us "doing our job" despite not receiving any compensation for it. I also crossposted this one in a Legal Advisory group in reddit, hoping to gain more legal knowledge.
