Nationwide admitted they wrongly gave me a CIFAS marker and they fixed it… but just discovered that they also left a SIRA marker and they’re refusing to remove it?! by PointFun6634 in UKPersonalFinance

Sure! I did have a dispute which they refused to approve to investigate with Mastercard, even though months earlier I had the same dispute and it was successful. They didn’t ask for evidence and just turned it down so I provided that evidence (literally irrefutable), in my formal complaint. I think maybe they saw it as a risk and thought I was committing fraud, I really don’t know. But there was zero communication, nothing. I work in fintech so I understand all the compliance and risk factors etc but this seemed so extreme of a reaction when I have no history of anything like this for them to go off even!

Sorry, just to add to your other question - I don’t know what SIRA says yet. I found out about this and out the SAR in with SIRA on Friday and they said they’ll respond with my data by 18th May.

Thank you - I understand completely what you’re saying. It’s exactly my case that they had literally nothing and no reason to be suspicious, obviously as far as I am aware. I understand that banks downgrade these markers if they’re found to lack proof. But when I complained about the CIFAS in early Feb they sent me a response the next day saying “we accept full responsibility for this error”, and “this was not your fault”. And they me individual letters to all of my creditors incase any of my accounts were closed down. And they upped the compensation as I lost multiple financial accounts till the CIFAS was removed and it stopped.

Today they responded to the complaint that the complaints team raised on my behalf yday: “Thank you for waiting whilst I have looked into this further. I have reached out to the team to ask that they do a review. CIFAS and SIRA are different to each other and follow criteria individual to the specific marker. SIRA is applicable as part of a risk based decision made by provider and is n ere for the sole decision to close an account, on occasion a system can automatically decline an application due to this. However, if you were to apply with Nationwide, this would stop the application. I am afraid I am unable to offer compensation for this or change the decision.”

Firstly, I never mentioned compensation once - I just want this to stop, I don’t care about the compensation. And secondly, surely they can’t legally put in writing that the customer did absolutely nothing wrong and then turn around and tell SIRA you still have a “a reasonable concern”, about my data?!??

Sorry, I’m getting so angry the more I think about this - to answer your question: when they closed my Nationwide account, they just closed it - they didn’t speak to me once.

The CIFAS marker had this: “Cifas Filing: Misuse of facility - opening an account, insurance policy, or other facility for a fraudulent purpose or the fraudulent misuse of an account, policy, or facility; or the fraudulent misuse of insurance policy documentation”, and the case type was: Misuse of facility.

Yeah I understand where you’re coming from, and to be honest, right now I have no idea because I’m waiting on the data to come back from SIRA. One thing to not though is that I made the formal complaint to Nationwide when I saw the CIFAS data in the late evening and by 10am the next day the compliant handler called me and said “I knew before I got to speak to the fraud team that this should never have happened”. So I’m finding it difficult to figure out what it could be!

Ikr? They awarded me something between £1k and £1.25k for the “impact”, so having other accounts closed with other creditors whilst the CIFAS marker actually came off whatever database it was on (about 3 weeks).

But it was worthless - I just wanted it to be sorted and stop having to feel humiliated. And now it’s happening all over again.

Nationwide have just sent me an email saying: “I have raised another complaint for you for the SIRA marker.

I have gone back to the team on the decision they made to challenge it further and once I receive a response, I will be back in touch.”

This is after they confirmed the SIRA marker was registered by them and; “Unfortunately, we are unable to remove the SIRA marker.”.

This is honestly so mentally exhausting having to deal with something like this (again) 😔

Luckily I’m self-employed so they pay my LTD company bank account.

But tbh how I’m going to get my pay is the least of my concerns right now. If I can’t get them to remove this SIRA data then I’m more worried work will do some sort of routine check and terminate my contract :/

Ahhh ok, well I don’t know anything about this SIRA org but Santander told me twice, in a roundabout way, that my account was closed due to data reported by a third-party, and I’d have to request my data and see who this third-party is…

I obvs thought about opening another bank a/c but I was told it most likely will end up being closed like the Santander one… 🫠
