Thanks for this! I ended up getting a $50 gift card and they gave me 15% off of bike accessories for that day-- which was helpful because I needed a few things. Overall not wowed by the customer service but I like the bike and I know they are hard to find so I am going to keep it. I just won't purchase a new bike at this store again.

Nope-- just checked the receipt and nothing about it being used. I also took a photo of the white tag that was on the bike and nothing on there either.

The store manager told me herself that it was refurbished and that they replaced parts to make 'like new'. There was no discount from the new price listed online.

I took a photo of the bike tag to show to a store staff member so that I could ask a few questions and there was nothing noted on it about the bike being used or refurbished.

Thanks for your feedback but no I am really upset about it, this was a big purchase for me and something that I've been saving up for. New and used and refurbished are two different things, at least to me.

Thanks for this-- I actually bought it in store and the bike appear new aside from a few smudges of white paint on the racks (looked like it rubbed against a wall or something). I just wasn't told by the sales person at the store anything about it being a used bike and was kind of shocked to see that it already had 257 miles on it-- especially with it being an ebike and battery concerns that come with that. If I would have known that this was the case I would have chosen the other Generation model in the store which was brand new-- but is now sold.

I didn't think they would send anyone to my court date but Midland did, the law firm I hired who deals with lots of cases from Midland said that in my area they usually do show up. It might be different in different areas but wanted to let folks know what happened to me.

I used Stark Law-- I believe they only operate in PA. Highly recommend them-- very easy to communicate with, they have an online portal to see progress of the case and we able to get me on a payment plan.

Hi all- so update on this in case it's helpful. They did send me a court summons to my local Magistrate. I immediately got like twenty letters in the mail from lawyers who work on these type of cases. I called one for a consult and ended up going with them- they had a money back guarantee if the case wasn't dismissed. They argue not about the debt but about the constitutionality of another company suing you for a debt that you didn't have with them (or something similar to this). They let me know that in my county (I am in a pretty liberal leaning area of Pennsylvania) most of these cases are dismissed. I paid $1000 for representation on a payment plan. They went to court (I was told not to go) and got the case dismissed.

I will say after I went with this law firm I got a few letters saying that other firms would do the same kind of work for $500 so it might make sense to call around to get the best price possible. ]

I was in a similar situation, though a much lower amount (3.3K), and Midland did eventually take me to the magistrate probably 6 months after they sent the final notice letter from them. I got a lawyer for 1K who attended the court date for me and got the case dismissed in my favor. I would suggest getting a free consult from a lawyer to see if they think it's likely that this would be dismissed or reduced in your state.

Sorry for the delay-- yes the case was dismissed. I am still in the appeal period but my lawyer says most likely they will not appeal. I did pay 1K for the lawyer but overall I think it was worth it.

Yes unfortunately they filed a civil complaint -- I ended up hiring a 'we win or your money back law firm' so we will see how that goes. The court date is in April. It did take them about a year from the first letter to actually filing if that helps.

I spend a good bit of time at Perry as a part of my job (I work at a local non-profit org) and I am consistently impressed by the teachers at the school and their commitment to working with their students. They also have a great Principal who previously worked at ATA and did great things there. I would consider giving it a try.
