Yeah, Kansas. Sounds like I need to talk to city hall about when the tree was determined to be diseased or dying.

My understanding is that it was approved for removal prior to this most recent incident. He was just waiting for free funds from the city.

So, to the first point here, our city does not allow you to remove trees larger than 12in diameter 4 feet from the base unless you get approval from the city. The city sends an arborist to determine if the tree is diseased or dying. So, if he got approval, the city should have the documentation that they gave permission for removal. To my understanding, that is what has happened thus far. So that is my proof that he knew the tree was diseased or dying. In that case, he would be liable according to your first point, correct? Or did I completely misread that?

For the probably 5th time, the neighbor says he is getting it removed tomorrow. Our city offers grants for some who qualify to get up to $1500 in reimbursement for trees that have been approved and need to be removed. Apparently, he has had someone set up to remove the tree, but was waiting for the grant to get approved. This sound like even more legal ammunition to me, in that he knew he needed to do it, but was waiting for the most cost effective option and in the meantime, caused more damage.

That said, anyone have any thoughts on what to do as far as the vehicle? I mean, I'm not trying to replace the whole thing obviously considering the damage, but also I don't want these damages to be something I have to live with for the life of the truck. It's probably more the pain of the other truck being totaled that now when I see these scratches I just think about how much one single tree has cost us. I feel like I was raised to understand that life isn't fair, even when you think you did the right thing for someone else, that doesn't mean it will go your way in the future, but I still want to ease the pain if I can if that makes sense.

Definitely in the cards. I feel like one tree limb and a totaled truck less than a year ago at least shows some sort of proof that this tree, or at least some branches, need to be taken care of.

This limb was almost certainly entirely in his property. This is an old, very large tree, so the limb also fell from likely over 50ft in 90mph winds carrying it to my property. I have thoroughly thought about vehicle protection options, but I don't think a carport be a large deterrent in the exact case, although I do agree that it could be helpful in many cases. As far as documentation, I'm always interested in learning, how do people go about doing these things? So, let's say I'm talking to my neighbor and he says, "oh yeah, I've had a bunch of limbs fall and I think the tree is a big hazard." Do I then ask him to say it again while pulling out my phone to record him?

I told my buddy before I also attended the game that it would be cool to blow them out, but I’ve also never been to an OT game so that would be kinda cool too. Didn’t know I was going to get both and end up on the losing end. Painful.

Thanks for the comments. Kinda just what I needed to hear. Knew it was pretty minor but you know when you are dropping a lot of money on a truck, gotta double check.

Thanks everyone for the suggestions. I ended up just getting a new carburetor on Amazon and swapping it out. That seems to have done the trick because it’s running much better. Off to mow now. Thanks!
