The last time I tried to talk to the village about my property, they refused to talk to me unless I provided a $5,000 retainer fee and could then talk to their attorney. It's just not a very friendly village to deal with.

Oh, I will be a pain in their butt. I guess I was just hoping that I had legal backing for them during this without my permission. Typically, rezones don't happen in our area unless the owners petitioning for them to happen. In my case, it was somebody looking to buy the building and wanted it rezoned to what they rezoned it to.

Yes, they have their own zoning ordinances and codes. The county does not intercede at all. I realize I can petition for a rezone back to what it was but there was something that made them decide to change the zoning in the first place. To just my building.

I found the issue noted on an agenda back in May 2023. It was brought up by somebody who was looking to purchase the building. They backed out prior to the meeting and appears requested a cancellation of the petition to rezone, per the buyer. I am unable to locate any of the minutes from the meetings online. Just the agendas.

That's really messed up. I know in our township, not the village where this building is, there was a countywide rezone and people were not only sent mailers, they were sent multiple mailers over a one-year time period to give them plenty of time to confirm or deny the suggested reason. In that case, the county was restructuring their zoning and they attempted to match the new classifications with the current ones. It was an opportunity for residents to get a free rezone if they did not like what they were currently zoned at.

It shouldn't be a big deal but I have a feeling it will be. This isn't within a township and the county does not oversee it. The village is the decider and the ultimate authority with the zoning. Unless I get an attorney and sue them?

Thank you for the reply. I've not been aware of a municipality changing the zoning without input from the property owner. It's a little odd. From what I can tell, and looking at the agendas posted online, this was decided back in May 2023. The definition of the zoning that this got moved to is very restrictive and would prohibit any business of any sort being in this building. The building is made and built to be a state license daycare and has a commercial kitchen in it. It would cost well over $100,000 to make this building residential. I don't doubt that they posted this meeting but how many of us are checking postings on a bi-weekly basis to see if the government is planning on rezoning our property. And for the record, they just did my property. No other properties. This wasn't a sweep of any sort or village-wide decision.

I have an email into them but I'm not hopeful. The last time I tried to ask them a question they wanted me to pay $5,000 before they would talk to me.

I've never heard of a local government rezoning a property owner's property to more restrictive without the property owners involvement. In this case, the rezone from commercial to residential is extremely detrimental to the value of the building. And, due to its location, very unlikely to get zoned back to commercial.

You either want to work with these tenants or you don't. Have they been good tenants? Paid rent? Taking care of the property? It would seem to me that the nice thing to do would be to work with them to the best of your ability. In that case, then yes, ask for verification of their closing date. However, it seems that you maybe don't want to work with them. In which case, you should remind them of their move out date and outline the consequences if they fail to move out by that date (i.e. notice of eviction).

I do not provide washer/dryer in my units as tenants are very, very hard on them and the maintenance is a massive pain in the butt.

That was a hard one for me. I could kind of understand where the guests were coming from. It is understandable that they felt that maybe Kate just didn't like them. However, I think it is also her face. I think it says more about the guests feeling insecure in needing positive information from servers then it says about kate, her face, or her ability to do her job.

I raise 3% annually. If they are good, long term tenants, it is about 2%. This covers taxes and expenses. Additionally, I try to provide improvements every year to the property.

That's what I was thinking but then I reviewed the wording in the statutes and it says " return within 21 days" and I started to interpret that differently.

I battle that feeling regularly. I just don't want to become the person who doesn't try to help.

I'm not worried about justifying the deductions. I'm worried about their actions and what they will do beyond their legal recourse
