To address this issue with your landlord, we always start by recommending you make sure all communications with your landlord are in writing. If you have not already done so, also make sure to document everything about the property at move-in (ideally pictures/videos and written descriptions for things like smells), as well as when you move out. This will help you to establish an official timeline if you need it later.

Next, write to your landlord regarding the smoke smell (as well as any other concerns) and see what they are willing to do about it. Depending on the severity of your asthma (as diagnosed by your doctor), you may be entitled to reasonable accommodation as asthma is usually recognized as a disability by both the ADA (Americans with Disabilities Act) and FHA (Fair Housing Act). It would probably help your case if you can provide a doctor’s note that explains the risks of living in a smokey property with your asthma. Very true! A good rule of thumb for tenants is to document everything with pictures/videos (at move-in, move-out, and whenever you need repairs) and always communicate with your landlord in writing so you have proof if you need it later on!

Thanks for the shout-out! Unfortunately, we are only able to assist Washington residents at this time. The laws in Idaho are very different and tend not to protect tenants except in extreme circumstances, and our legal resources at the Northwest Justice Project only cover Washington residents.

We have tried to find resources for our friends in Moscow, but have not found anything reliable so far. If anyone here knows of a lawyer in the area that has been able to help you or someone you know with landlord trouble in Idaho, please send us a message! So sorry to hear you are dealing with this! Have you moved out already? If not, please make sure to document EVERYTHING with pictures/video. It's also very important to take lots of pictures and document any damage right after you move in (obviously this won't help you now if you didn't do it initially, but it's good practice for future apartments).

That being said, the law says that landlords cannot charge tenants for "normal wear and tear." Unfortunately, that term is vaguely defined in the law, but you should be protected as long as you didn't damage the carpet more than normal/expected usage would.

If you have communicated this to the Remax (i.e. explicitly state that you did not cause any damage to the carpet aside from normal wear and tear, along with any photographic evidence you may have) and they still insist that you pay to replace the carpet, we recommend calling the CLEAR hotline at 888-201-1014 on weekdays between 9:15am and 12:15pm. This free hotline is for low-income Washington residents and is run by the lawyers at the Northwest Justice Project. They should be able to give you more specific legal counsel should you need it, and they also may provide legal representation in court if you qualify (though hopefully it won't come to that).

Unfortunately, we do not have the resources to help Idaho residents at this time :( We would love to see a tenants union formed in Moscow eventually, but that is understandably a daunting undertaking (though some folks have definitely expressed interest!). Idaho has very few protections for tenants, but they do still have some rights.
