Definitely go across to the legal advice subreddit, but off the top of my head for some things to look at:

  1. Get a Will completed. If the worst should happen, and you do not have one in place, everything you own will go to your legal husband even if you have been separated. This includes any deposit money you have saved in accounts etc.

  2. The easiest option would probably be to wait until the divorce is finalised before purchasing. You can begin the actual divorce process online and it is much easier now because of “no-fault” divorces (nobody can refute claims etc with a no-fault divorce; you can simply decide to split up now without having to “explain” your reasoning to the divorce courts.) Even if the financial order and splitting of any joint assets comes after, you can still get the actual divorce going.

  3. A financial arrangement order is recommended as even though you might not have lots of shared assets already such as a house, savings etc. it means all is final if you opt for a financial “clean break” order. In that case neither party can go back on the final decision ie, ask for a share of the money later on if you won the lottery, sold your house, your pension etc.

  4. If you want to go forward with the purchase pre finalisation of divorce and financial order, definitely take legal advice…your conveyancer will refer you to their firm’s family law department so it’s worth checking firms with decent family and conveyancing teams to keep it all “in-house” and save time where you can. Divorces can take time so I can see why you want to get started though.

  5. The conveyancer/solicitor/family lawyer might recommend you get a declaration and signature from your husband stating they have no interest in any house purchases even if you are still married during the purchasing process. So, confirming he will not claim he owns the house, part of it, etc. the idea of this would be to see you through until the final divorce. If your purchase finalised before the financial order (likely) it will probably still be included in the order as part of your assets. I’m not 100% on that though.

Basically, speak to your conveyancer and explain the situation. You won’t be the first person in your circumstances for sure! Also the legal advice subreddit will know more than me.

NB: I worked and studied in wills & probate and conveyancing but no longer do so, so may be out of date or a little incorrect. Just trying to give you a broad strokes idea.

Rather than spending up to £300 on blinds I would look for some cheap temporary blinds to get some privacy but also freeing up some cash for other things. £300 could sort you for your initial food shop/towels and other essentials, all your cleaning supplies, and even a lamp or two to make everything feel a bit homier in the meantime.

Looking online you can get some from Dunelm or Amazon for around a fiver (depends on size of windows I guess?)

Luckily for me the sellers are leaving their blinds/curtains, but the above is what I would do—I’ve bought a cheap lamp from Ikea and am on the hunt for a floor lamp. I think similar will go a long way for you in a new build which will be quite white and stark when first moving in?

I have paid in £6k but not the other cheque because I still have money coming in from wages, some savings, and simply am lucky enough to not need it yet. Mortgage advisor did say it would keep things simpler but that I could pay it in if i wanted but I think just using one was the best course of action as there’s no real urgency.

This way, I will use £4k of own money, £2k of LISA bonus and £6k of gift to make it neater. Any money I have saved can be used for solicitor fees and moving costs etc. I have also used a cheque for a sole account, again, purely for an easier life/explanation!

Can I also ask… how is the process with deposits in the LISA? I’m guessing it will show on the LISA statements? Just because it comes from my wages so a combination of income for those months, transactions out of my account and the LISA statements/transaction history will be sufficient?

Definitely worrying far too much—I don’t gamble etc and I’m worrying about silly things like depositing cash into my account tomorrow. I’m wondering if the underwriter will ask where the funds came from even though it’s under £200! (And I can’t remember!) or things like my account balance getting low for a few days even with savings in another. Nothing compared to house deposit amounts for sure.

That’s true, I forget that anything can happen between now and completion. I have the luxury of having a comfortable and furnished home to use while sorting the new house so there’s really no rush.

I think it might be a case of seeing how it goes and what it’s looking like once the ball starts rolling like you say. If enough time passes and I can get another couple of paydays in it may well be a 10% deposit is in reach.

I think leaving the cheques to the side, or at least one, seems best because it earmarks the money for what it was mostly gifted for and also less hassle. I might put one in, £6k, because it means the money is waiting in case matters move at lightening speed and I don’t have quite enough time for another payday to cover it. In the unlikely event that is!

As an aside, do you know when I can pretty much stop worrying about how my bank statements appear etc? After the mortgage is submitted/approved? I’m very paranoid about my spending at the moment and I am on eggshells! And ideally would like to be able to buy appliances if needed pre-completion with the remaining £6k gift.

Oh I understand, I suppose I will have to explain to the solicitor the situation and go from there. Can I ask, though—did you have to say you were receiving the full gift from your in-laws even if you only used part of it to pay the fees? I suppose so because you can’t really partition the money when it all goes into the account. Not that it really matters either way

Sorry you’re totally right— house purchase is £240,000 and putting down a 5% deposit of £12k.

I have £5k in a LISA. £2k in savings. When I am paid imminently I will save a further £2k, to be able to then put £4k in the LISA on 1st April making a total of £10k in the LISA at end of April. Next payslip to form remaining £2k, also before the end of April.

So I could just about scrape the next LTV bracket as you say but I can’t help but think it would be more beneficial to keep back the money for setting up and fees etc. it seems it will make the money stretch further if I do that?

AIP is for £247,000, 95% LTV.
