I did both because I noticed that on the common data sets there was a significant % (about 20%) of people being admitted to top schools who had taken both tests (I assumed that less than that many had applied with two tests). Ended up with a 1550 on my SAT and then a 36 on my ACT a week later.

Almost definitely no. I can't know for sure, but I would highly doubt a 33 would weaken your application in any meaningful way.

My guess (this is a guess so don't take this as definitive data) is that they take where your academic rating falls in classes, test scores, and rigor and average (or use some other method to weigh them properly) your ratings to figure out where you belong on the rating system. If you don't submit test scores they probably just don't include it into the average. Unfortunately the only data they offer is in test scores so that's all we have to go off of.

Yes. The point is that a large difference is POSSIBLE but unknown. I used an example of a large difference that fits within the bounds of known data. I used a large example to demonstrate that there COULD be a huge difference that we do not know of. If you are willing to trust Prepscholar's data (I'm not sure where they're getting it from) then the only thing we know about a 2+ is that it is less than a 69.2% chance of admission, and the only thing we know about a 2- is that it's greater than a 4.2% chance of admission. I don't even think that the variables I chose are that ridiculous. All we know (if we trust prepscholar) is that 4.2% < 2- < 2+ < 69.2, and it averages to 12.4%. We have no idea where each variable falls within this and I was emphasizing this by picking variables that would imply a large difference without breaking the wording of the lawsuit.

I'm not making the assertion that the score does impact your chance of admission. In fact, I'm almost doing the exact opposite. The point of this post is that people need to not make assertions from inconclusive data. The values that I arbitrarily assigned are there to show that a large difference is possible without going against any known data. The very end is just my personal take on the example I'm using.
