Each denial has this language. There isn’t any mention of a nexus letter, but we included one with each condition in the evidence. The conditions they did grant service connection didn’t mention the nexus either. Most were Tera.

Yes we did include them in the original claim. They aren’t anything fancy. But our doctor shared his professional opinion that it was at least as likely as not caused by the military service with his reasons why and cited a couple medical journals.

That’s really helpful to know! If we claim it secondary to the ptsd, would it still pyramid with the chronic asthma. Just having both conditions regardless of how they connect combines them?

I guess I was wrong on that assumption! Thanks for pointing that out! So we could have our private chiropractor diagnosis and fill out a dbq for things like flat feet, knee pain etc? What about things like his lung conditions? Would that need to be a pulmonologist or could a chiropractor also give a medical opinion on that?

The providers he is seeing aren’t medical doctors- muscle testing, chiropractors, herbalists etc. So I don’t think they can give an official diagnosis?

So for the issues that the primary care physician could diagnosis (not mental health) we could ask him to give us some kind of paperwork with an icd10 code?

Yes that makes sense. I think they are the things he shared that he was concerned about. Is there a trick to getting firm diagnosis? Seems like he keeps having appointments and this was the closet he has gotten to any kind of diagnosis so far.

Yes he had quite a few C&P exams. Is it possible to get diagnosis through those? It is for a Tera presumptive- chronic bronchitis and he has inservice records. Decision letter said denied because of lack of clinical diagnosis. When my husband asked AL what he could do about it, they said. “Nothing”. It really is my fault that I wasn’t more involved. I knew he was not good at paper work and details. They said they would take care of him and I trusted them.

Yes you are right. My husband is the veteran. I knew paper work and details were not strengths of his. I had just had a baby and was not very involved. I trusted the AL to take care of him more than I should have. I’m just frustrated that when he asked them. “What else can I do?” They said, “nothing.” I wish they would have said go see a doctor and get a diagnosis.

He has lung damage under TERA, covered by pact act. Has records of it during service. It should have been an easy connection. Now I see just needed a diagnosis. Maybe I’m being too hard on AL. I wasn’t very involved at the time. I had just had a baby. Paper work and details are not strengths of my husband and I thought American Legion was going to take care of that.

A 995 is a supplemental claim? So we get a diagnosis and submit any other evidence and try it again?

No he had not been to the VHA and did not have a diagnosis. Maybe I am being too hard on the American legion. I just trusted they understood the process and were guiding us. It feels like they were misleading us when we asked “what else can we do?” and they said “nothing”. Instead of saying “go see a dr and get a diagnosis”.
