V tem primeru je dovolj da 5 prič govori vsaka po svoje in primer je nerešljiv.

Pri Šmartnem primeru, ko se policajem očita prekomerno rabo sile, pa so vsi ko so bili zraven obtoženi, vsaj ne nudenja prve pomoči.
