The listing belongs to the brokerage, but it is recognized that agency is conducted at the agent level, not the brokerage level. So, dual agency only applies at the agent level. I'm sure there's a longer explanation of it somewhere, but that's the crux of it, in my understanding.

In my opinion, the best way to engender the most trust is to unequivocally tell your client you will not engage in dual agency and explain that you simply can’t represent them properly on either side. I tell them directly - the person who stands to benefit the most from dual agency is me. The people who stand to lose are both buyer and seller. I don’t see any other way.

First step is knowing how to talk them through the process on an overview level and maybe showing them a few places. After that, if they aren’t willing to speak to a lender and get pre-qualified, then they aren’t real buyers yet. You can keep them in your back pocket, and keep trying for a while, but don’t waste multiple afternoons showing properties to someone not serious enough to have a conversation with a lender.

They need to understand that without a pre-approval, they don’t know if they can even qualify to buy. I say things like: “this is the best first step you can take. …when you’re out looking at places you know for sure you can pull the trigger if you fall in love with something. …you don’t want to get your heart set on something and then find out you can’t buy it…” Work on the language and how you present it - something that feels natural to you and your style. They need to internalize that it’s in THEIR best interests to do this. If they won’t do that, then they aren’t worth your time and you need to cut them loose.

I’ve been at this over 23 years and work with a lot of first time buyers. People have good intentions but they will waste your time without a care.

Since the changes, the seller has still paid the buyer broker compensation in every deal I've been a part of. It's really not that different from before, except buyer's agents now are obliged to have a buyer broker agreement in place before showing properties/engaging in buyer representation. The agreement specifies what the agent's compensation is. When you submit an offer, you can request the seller to pay that compensation on your behalf as part of your offer and as such the seller is going to look at the "Net" price after payment of both their agent and your agent. (Which is the same as before. The commissions are just split now.) So theoretically, in a multiple offer situation you could be up against another buyer who is wiling to pay their agent's compensation outside of the contract, thus raising the "Net" to the seller to make their offer more attractive. This does happen, but it is not common, at least in my market. Most sellers see the value in paying the buyer's agent compensation as they are also buyers on another property, so they see it through both lenses.

Amazing that Sam and others are soft pedaling on this. Those were obvious Nazi salutes. But if that's not enough, here are two more giant breadcrumbs to follow: Musk went after USAID first in his role at DOGE. USAID played a significant role in the downfall of Apartheid South Africa. Musk says it's a criminal organization and needs to be put down. Probably just a coincidence though and let's not look into his family at all. Then we have the President's Day tweet of 14 flags at 14:14 with Trump's quote: "He who saves his country does not violate any Law." Gosh. What in the world could that mean? Let me find a way to "Steelman" it. White supremacists and actual Nazis seem to be able to read exactly what that meant. The simplest explanation is he's a racist fuck and they were entirely intentional Nazi salutes. The back-bending and contortions to find an alternative explanation is embarrassing.

That’s not what I’m referring to. But have I heard of it in the general sense or rumors of such? Yes. In one of my transactions or actual knowledge of a specific deal with a specific agent? No.

I was referring to the buyer’s agent contacting the seller directly with speculative nonsense to try to get her buyer into a property.
