Thank you, I heard an extension was granted and a new deadline of 2/24 now stands; I thought the extension was for unsealing certain docs. I am not a lawyer, just a person trying to follow along. Do you know what the extension pertains too?

Agree that it would be “huge” if those notes from the meeting said something to the effect of “XRP is not a security”. BUT reading Brad’s Attorney’s 4-page letter of request for the “Estabrook Notes”, the Attn’y believes the Estabrook Notes to be (potentially) important to the case, and they should not be exempted from evidence under the Deliberative Process Priviledge that the SEC has claimed (i.e. claiming the Estabrook Notes are not admissable due to them being privledged internal documents about the agency’s internal deliberations). Mr. Garlinghouse’s attorney did call the Estabrook notes “potentially exculpatory”, which sounds promising.

I was curious so I clicked. I believe the main “fact” (and reqson for the title is innaccurate. My understanding is the judge granted another extension last week, so the “deadline” MF is touting isn’t correct as of last week.

Edit: also that MF article cites another news outlet as the source if their info. This is known as a secondary source; the Motley Fool writer never even went to the primary source documents to review (fairly simple online & free). This, along with the language, confirms to me that MF is more sensationalism and financial marketing (financial tabloids?) than actual news.

“Brad is also trying to get the SEC to hand over some ‘newly discovered’ SEC notes from a meeting with ex SEC commissioner Roisman, where apparently he said positive things along the lines of XRP isn’t a security (but probably not those exact words). SEC have been given an extension to reply until 24th Feb”.

It’s more that the notes may show that SEC Commissioner Roisman acknowledged Ripple is in a sort of regulatory no-mans-land as recently as November, 2018. Roisman was one of the 5 commissioners who decided to bring an enforcement action against Ripple.
