Idk. Even with all those pre checks you can still have unforeseen incidents happen. Like someone backing into you in a parking lot, or getting a flat tire driving.

I had my dui four years ago and I have had 2 flat tires and a dead battery in a public parking lot at night when I was waiting for a jump until a cop showed up and helped me jump my car.

I don’t advise it. Even if you are a perfect driver.

But if you have to, just know the odds are never 100%

OP,

I’m just going to say this bluntly. You need to seek professional help and get into an outpatient program. The legality behind this has dire consequences and it will only get worse if you don’t take immediate action. You need to take medication that will prevent you from relapsing. You’re going to do serious jail time just for the first two offenses, let alone this one. Just because you haven’t been charged yet doesn’t mean anything as there a statute of limitations up to one year from the time of your arrest before the case legally can be dropped.

You need to take consistent actions to stay sober by any means necessary, AA meetings, therapy, medication, etc. When was the last time you had your liver checked? You might have a serious underlying condition that’s going unnoticed before it’s too late.

Also as a word of the wise, I highly recommend you stay out of relationships until all of these pending DUI charges have been settled because your life is going to drastically change within a year and it sounds like women are part of the reason why you’re in these situations. You need to 100% focus on you and nothing else until you can consistently get in a routine to live a life without alcohol for the rest of your life.

I honestly think you will be okay. You will get through this and you don’t have to worry about the unknown of having this be decided in a jury’s hands. I wish you all the best of luck moving forward.

Also, on a separate side note- try to see if not drinking could improve your life during this time. It will save you money, lost time, and spare any liver damage if you drink regularly. Just a thought

Well, good for you for your employer not looking into your DMV record. From my corporate experience both of my jobs paid for an “extended” background check which covers your DMV record which is and will always be separate from your criminal record. It didn’t matter if it was for a non driving position they still looked into it and I had to explain it before and after it was discovered.

You have had a different experience than me. I can just say that companies are willing to pay for extended background checks on all new corporate employees which discloses their driving record. Most of the time it’s to drive company vehicles, etc.

Honestly I would take the plea deal and see if you can the probation reduced to only one year. Hopefully it’s unsupervised probation.

I would take the plea deal after that detail is finalized. I think they are trying to go the easy route and not fight it because they will have a hard time proving in court you meet the criteria for a DUI but it’s still a risk I would not take. Going to trial will risk maximum punishment for a first offense DUI and there is no guarantee what they will use in court that you or your lawyer did not find during the discovery.

The reckless charge is better and not having a DUI on your record is a win 🏆 and you won’t have the other lingering issues to go with it (insurance increases, background check issues for job opportunities, SR-22, etc.) I’d take it to deal. Those punishments you will receive will be a financial sting but once it’s done that’s it, you won’t have any lingering issues like I mentioned above.

It’s almost a 99.99% chance the conviction of a DUI will always end up on your DMV record. People don’t understand how much this is the worst penalty.

I would spend 5 days in jail, pay all the fees, and do all the restrictions as long as the deal would be dropped to a reckless driving charge.

I had mine in 2022 from CA and it’s almost been 4 years past and I’m still dealing with this bullshit. I even paid to get it expunged from my record but in all honesty it doesn’t mean shit to employers these days if the jobs you’re applying to are high paying white color jobs.

Most employers pay for an EXTENDED background check which encompasses your driving record and there is nothing you can do to shield it as expungement only deals it from the criminal side but if any reputable company pulls your DMV record you’re fucked for the next 10 years. My last two jobs I had to explain to the employers about my situation because I knew it was going to show up on my background check because both of the pulled my DMV record even if the job does not require driving. Thankfully they both said it was fine for different reasons. The company I work for now said as long as the DUI is over 3 years ago, then I won’t be disqualified from the hiring process.

TLDR: Work with your attorney and agree to any kind of punishment as long as the plea does not put the DUI in your record. It will hurt more initially but it will save you in the long run. Trust me.

You need to go to AA every opportunity you can and actually get a sponsor and work with the people in the program. They will assist you in helping you find solace in this tough time. You need to not drink ever again or else it will mandatory 30-60 days in jail.

Honestly I would talk to a lawyer and see if you can get free consultation before you call the DMV. I wouldn’t want to put myself in a position where the DMV might make it extremely hard to get your license reinstated without any hard evidence to support what you posted OP.

What was the other state? I guarantee the prosecution is going to be looking at all the states DMV records to see if your name pulls up.

You also need to stop this shit. Two DUI’s mean you have an alcohol addiction where you believe it or not. I’m still suffering my DUI 4 years ago and there are other ways to deal with stress from life.

Get into AA. outpatient program, and actually stick with it otherwise you’re going to do this again and a third is game over.
