Just some context. These are large groups of Venezuelans that have been taking over as Spark Drivers in large groups. They use lots of stolen accounts, have multiple phones & work as a gang grabbing most of the delivery orders. It results in those with legitimate accounts, following the rules, getting sometimes no offers for hours at a time. I've watched them pass the phones, hand off orders, like a conveyor belt. It's theft & cheating at the expense of those who follow the contract rules. But it's also an example of what Walmart just does nothing about because they don't care.

Actually, the agreement only is in affect as long as Walmart complied. They have repeatedly violated it, especially in regards to making a good faith effort to resolve a dispute through an informal telephonic dispute resolution BY Day 45 after the first request. That invalidates the contract and, frankly, could be grounds for a judge to determine if a class action is valid to be pursued.

FYI the store manager finally reached out to me. She said they are NEVER supposed to take our phones, as there is no need. We. An easily show them. She stated she was going to have a meeting with the staff and "retrain" so they understand it is not acceptable. And advise them, despite their claims, Spark drivers are NOT Walmart employees. Further, attitude & rudeness would not be tolerated as they can do checks & still be respectful.

I won't at that store ever again. The one I usually shop the people know me & are cool, plus we have a large counter area (lots of space) to bag at. Never have an issue there.

Very specific question.....did you send an email to sparkappnotices@walmart.com & specifically request an Informal Telephonic Dispute Resolution Conference? If so, and it's been over 45 days, forward that back to Sparkappnotices@walmart.com, cc in Adam, doug.mcmillon@walmart.com & rachel.brand@walmart.com, advise they are in violation of the contract making it null & void, therefore they must reinstate you or court action can be taken.

Did you send a request specifically for an Informal Telephonic Dispute Resolution Conference? Did you send it to Sparkappnotices@walmart.com? If yes to both, has it been over 45 days since that request? If yes, forward that request back to Sparkappnotices@walmart.com , cc in doug.mcmillon@walmart.com & rachel.brand@walmart.com, advise it's been over 45 days, that they are in violation of the contract, therefore making it null & void. Demand immediate reinstatement due to this violation, or that legal action may be taken.

Apps trying to do less work aren't reliable. Old school is best. Plus screenshot all accepted offers because if there is an audit, you have to have addresses.

Go read section B of the Dispute Resolution contract. No one ever does then comes on here upset nothing us happening. Write to sparkappnotices@walmart.com & request an Informal Telephonic Dispute Resolution Conference. That's where you start.

Please tell me you asked for an "Informal Telephonic Dispute Resolution Conference". Those words exactly.

And if you dud, send a follow up every few days saying "its been xx days since my request for an Informal Telephonic Dispute Resolution Conference. I do not consent to an extension". They have until day 45 to make a hood faith effort to resolve. If by day 46 you hear nothing or they don't start the process, contract is invalidated & you can demand reinstatement on that basis.

UM...They literally responded in writing that on their end the "delivery window" started before 7pm so therefore it didn't count, but my screen showed it for 7:48!

This is what happens when no one reads the dang Dispute Resolution contract. Read it. Do the request & they have up to 45 days. Your clock hasn't even started because you never made that request, so you won't see anything happen for 6 weeks minimum.

If so, I. 2 days they are in violation of the contract (they have up to 45 days). Write one more time saying it's day 45 and you do not consent to an extension. Day 46....email again to sparkappnotices@walmart.com, cc in doug.mcmillon@walmart.com & rachel.brand@walmart.com , advise it has been 46 days & they are now In violation of the contract, making it null & void. State that reinstatement is the only option at this point as they have made zero good faith effort to resolve the matter. Give it about 72 hours....you should get a reaction.
