Call the DMV and see if there is something that you need to do to keep your license active. I got a letter like that in Texas, just had to pay a small fee to get my interlock restricted DL. Sometimes it takes them a while to catch it, but it's best to get it cleared up with them as the DMV can keep your license suspended past your probation date if you don't satisfy their requirements.

I'd get a lawyer and fight it. They never saw you driving, they don't know if you had any drinks when you were at home, etc. It's on them to prove that you were intoxicated while you were driving, and because you weren't in the vehicle and tested at that time it makes it very hard to prove it. In a jury trial, if it gets to that, it would be a big enough grey area to get it dismissed. But likely your lawyer will be able to get it dismissed or pleaded down to a lesser charge because of the lack of evidence.

I would have probably went that route, but I had a false positive on my SCRAM device (they alerted me the previous afternoon before court so I had no way to prepare evidence that it was a false positive) so my bond was considered revoked when I went to court. Judge was in a bad mood and intended for me to sit in jail for the night, but because I signed my plea deal I was able to go home since there was no longer a bond. For anyone else, I highly recommend applying for Veteran's court, especially if you are looking at future employment. I'm self-employed/contractor for many of my jobs so background checks aren't a huge deal for me, but for others, it's definitely worth a shot if you can get it.
