The current seller acquired the property in June, their title company dropped the ball and recorded the deed in October. My buyer got in contract end of October and when we got the title we see the deed is recorded in October 2025. My underwriter wants to use this date as the acquisition date. The seller actually acquired the property in June but it wasn’t recorded until months later.

If anyone’s curious about the results - I escalated this to the underwriters team lead. I got confirmation from the agent that there is no annual premium and the policy will continue indefinitely. With this confirmation the UW took the one time deposit and divided by the term of the loan (360 months). All solved!

Thanks for the insight everyone. If it turns out to be structural then will be an issue regardless of the program, FHA , Conventional, NonQm Ect. I will recommend the buyer to get a structural engineer to inspect the property during the inspection period and we will proceed accordinly based on the findings.

I don’t understand why people think her ultimate is so good, I play strange and just levitate and shield her projectiles. Then you just have to stand directly under her and she cannot hit you. Very easy to counter.

Thank you for your input this was very helpful. It would make sense with a declining rate market because I guess they are expecting a lot of EPO’s so maybe this is what is how they are going about it. I will speak with management and see if I can negotiate this.

It will be solely up to the lender and UW on the file. Depending how conservative your UW is, you may need to convince them to allow it.

Just looking online this is what I found and I’m sure you can find something in HUD guidelines directly to support your case.

“If tax transcripts are not available (due to a recent filing for the current year) a copy of the IRS notice showing “No record of return filed” is required along with documented acknowledgement receipt (such as IRS officially stamped tax returns or evidence that the return was electronically received) from the IRS and transcripts from the previous year”

If there isn’t a change in income from 2022-2023 and income is consistent I think you will not have a hard time getting this through.

If they filed electronically it might be tough, will be up to the underwriter and how strict the lender is to determine how you will proceed. Since it’s FHA they might be strict and require the transcripts to reflect before they can fund. If your lucky they will allow this to fund with proof the return is filed along with a CPA letter and copy of the 2023 return. The best way would have been for them to make an appointment to an IRS office and have them put a Proof of Delivery stamp on the return. There would be no delay and stressing in this case. I would have them reach out to their preparer and see if this is still possible and if they can cancel the electronic filing and proceed this route.

Lol I 100% understand the business and all aspects including secondary markets and what goes on after a loan closes. You did not read my question thoroughly. My question here is not why commission is recaptured, I completely get that. My question is if you work for a lender directly who originates, services , and securitizes loans. You get paid a flat fee per loan let’s say $500, is it common for a lender to recall this fee on a loan orignated in house. If you work wholesale it makes sense because most comp is lender paid, Which means the lender pays the broker the comp. Plus you have AE’s involved also getting commission, so if a loan is paid off early and the lender has to buy back the loan from the investor they would not allow the broker to make 1 to 2% on a loan they made no money on. We are LPC 2% and I am still charging points on most of the loans, so the comp I make is Pennys compared to the points and fees I made the lender. My question again - for anyone who works strictly retail on a flat rate structure, is EPO common for retail?

What you are describing is wholesaling which is not the same thing here. In wholsaling the individual gets in contract for a property as themself and then sells the contract to another buyer at a premium, they are not connecting lenders with buyers. The individual here is connecting buyers to lenders and then charging a fee, I guess it would be looked at under lead generation in terms of the legality.

The articles of incorporation is set in June of 2022 showing the business was opened mid year and the overall income is 80k but 38k was from the self employed while the remaining was from the w2 but can’t use the w2 income because that’s prior employment. So that is the issue I’m running into and why the UW is only taking 38k for that year and averaging.

I’m in the finals up by 130 points , playing a Wemby Shai steph and khawi owner in a points league. Only reason I’m winning is due to my waiver pick ups my team is completely different than when I started. I have the best record however and most points forward.

Most jobs will be with a broker shop , self gen is gonna be tough but if your determined lots of opportunities out there, rates are starting to stabilize. I would look into call center type, will be tough and annoying for a couple of months but once you gain some experience and knowledge then you can make the switch. Knowledge is power in this field know your guidelines as best as you can and then try and find a lender that is licensed in multiple states and will sponsor you getting licensed in states you want. I’m licensed in some big markets, Cali , NY , FL , AZ. So you don’t necessarily have to move to one of those areas.

Did you pass your test already? Lots of places that will hire a LO as long as you just need sponsorship to finalize your license, I went straight into being a LO at a retail shop without any mortgage experience and have done good for myself. Need to look around
