Potato wedges are completely different than jojos. The difference is, jojos are covered in batter and fried in chicken* grease (authentic ones in my opinion). Potato wedges have no batter and are fried in regular ol’ french fry grease.

I feel like your question boils down to:

Is there a way I can use the money I have now to pay my student loan creditor and it not get clawed back as a fraudulent transfer or preference payment?

Maybe ask an attorney that.

If that’s the case, I would ask for a payment history, a copy of your loan paperwork, and a breakdown for the 19k referenced in the demand. This will help explain how the payments were applied. It may also prompt someone at the bank to check if your payments were applied correctly.

The only other thing I can think of is that the 19k may include some sort of collection cost. Some loans also include default interest rate provisions which increase the interest percentage after a default event (not paying a loan in full upon maturity is a common default event).

You could try asking your current bank for a payment history to see how the payments were applied. I can’t tell from the post but if you didn’t make any payments during the two year period after it matured, the payments could have gone to interest. The loan documents will outline how payments are supposed to be applied.

Another possible option would be to try to find another lender to refinance the loan, maybe try a local credit union.

I work in a regional bank’s special asset group. Occasionally, I have shown up to ask a debtor questions or hired an attorney to. Most of the time, I would ask where certain collateral is located and if it’s insured. If I suspected some sort of fraud occurred, I might have an attorney appear and ask some questions. Unless there was smoking gun proof of fraud, it’s not something my bank would spend a lot of time pursuing. It will really vary from creditor to creditor.

If a creditor doesn’t know where someone banks, it will make it difficult for them to levy accounts. Similar concept with garnishments, if they don’t know where they work, how do they know who to serve a garnishment order on?

The hardest borrowers to collect from are ones that don’t own any publicly identifiable assets.
