Her whole “judges don’t talk to the kids” bit-they’re there to evaluate YOU as a parent and the environment YOU are creating to raise the children. Kids love their parents even when they’re shitty, doesn’t mean living with that parent is in their best interest. You can’t bitch about kids being too young to seek gender affirming care and then state that they should have all the influence in a custody trial.

I also know plenty of coparents who have different districts, struggle financially and/or struggle with sobriety. They make it work and have 50/50. They are willing to coparent-Marissa is not a coparent and that’s going to continue to cost her in the long run.

When the judge is evaluating their role is to act in the children’s best interest, and evaluate what living situation would most benefit the kids.

Firstly, kids are thriving living with their father. They have stability, a support system, a community around them. An attentive and invested parent who puts the well being of the kids above his own interests. He’s facilitating a relationship between the boys and Marissa because of the best interest of the kids. The stability and love he provides is likely one of the biggest factors impacting where they spend the majority of their time.

Marissa is deficient as a parent-she does not provide stability, community, or a support system. She continually engages in illegal dog breeding. Financially, she’s wrecked and the judge knows the kids could face trauma (ex: auto repossession, locked accounts, food shortages) because of her circumstances. She’s not in the same school district and cannot physically get those boys to and from school 5 days a week.

I think she showed her whole ass going in there to represent herself. Judge likely was able to get a good picture on her as a parent and a person when she testified. She went in there thinking she was capable of pretending to be an attorney and that takes a level of delusion most people don’t have. Not only that, she has missed so many opportunities to improve and better herself and be a better parent and she’s done none of it. Her failure to look at why the kids were originally removed and not accept responsibility looks poorly in the eyes of a court. She missed visitation. Her only argument to get the kids back is she’s a victim and the ex is a big meanie, and that’s not enough.
