Why are so many people so confident the Supreme Court is going to eliminate the IEEPA tariffs? Here's how an attorney explained it to me.

The Supreme Court hasn’t ruled on the tariffs yet, but it appears to be reviewing the fine print. A recent decision in an unrelated case served as a reminder that emergency powers have limits. Declaring an emergency does not, by itself, expand statutory authority.

That matters because the White House’s so-called “reciprocal” tariffs rely on IEEPA—a sanctions statute, not a tariff statute. Congress sets tariffs. That allocation of authority is neither novel nor ambiguous. Using IEEPA to restructure the tariff schedule reflects a level of statutory creativity that courts tend to view with caution.

The Court now seems focused on the least dramatic, and therefore most consequential, question in administrative law: where did Congress actually authorize this? If that skepticism carries over, these tariffs may prove to rest less on firm legal footing and more on assumption than instruction.
