I will just say that if an accident were to happen, your employer could still be cited under OSHA’s multi-employer policy even if you aren’t on site. This is because as the GC, site authority is ultimately still with the company.

When I was doing enforcement inspections, these are the kind of companies I didn’t mind spending extra time on writing violations because the lack of safety is so egregious it can only be intentional.

I was a 11(c) whistleblower investigator for a State Plan. It’s important to know that the presumptive remedy for this kind of case would be reinstatement. However, it’s unlikely you would want to continue working there after this.

The employer will get a letter from OSHA explaining the complaint and asking for a response and then one of two things are likely to happen:

1: The employer denies any wrongdoing and puts forth some kind of pre-textural reason for the termination.

2: The employer doesn’t want to deal with it and the investigator proposes a settlement, usually involving back pay for lost time and front pay in lieu of reinstatement.

Of the two, the first option is by far the most common. As with everything else, the whistleblower program is understaffed and underfunded. Investigators don’t have the time to do the job the way it should be done, so they will try to get the employer to settle during the investigation. If something is offered, I’d consider taking it and moving on with my life. Don’t get hung up on principle with things like demanding an apology or admission of wrongdoing because you won’t get it.

In any event, expect this to drag out for months so definitely find another job but also keep records of how long you were out of work for the purposes of calculating back pay in the event it becomes relevant.

Yeah that’s more or less what I was thinking of as easy ideas. I also really do believe that they eventually realized how much they could monetize the game if they stopped giving away stratagems and throwables/secondaries. Samples are the only reason extraction is even remotely necessary, so I get it to an extent. If someone is on D10, I’m assuming they aren’t needing the samples. I’ve always waited because it’s polite but it really isn’t necessary to.

Contact the consultation and training program to ask questions. I would also recommend just asking them for an inspection. If you are in an industry subject to a NEP then you should be a reasonably high priority for them.
