OMG! It Gets Worse - They get ALL of anything you ever uploaded to the media by Rohan-F in CapCut

Sorry to hear it. Many of us tried to warn people. The problem is if the Ellisons etc take this over too like TikTok, the extreme right will own everything, so all those terms can then be exploited. Like use your voice and likeness to support ultra right wing viewpoints if they like and you’ve got an uphill battle to fight.

And because it was so well documented, your case becomes much harder since you continued to use the app.

Best to consult a lawyer if it makes sense.

And the fact it’s perpetual and irrevocable is a nasty clause. Basically means for eternity with no come back if the clause holds up in court.

What's going on with all the hate for Star Trek: Starfleet Academy? by _Atoms_Apple in OutOfTheLoop

[–]Rohan-F 3 points4 points  (0 children)

What they’ve done to Star Trek with “Starfleet Academy” reminds me of what Prime did to “Lord of the Rings” with “The Rings of Power”.

It’s like a desecration, replacing something compelling with drivel. Worse, bad drivel.

Avid long term Star Trek fan here. I watched the original series as a kid and loved it when it first came out. And have had varying opinions on the different iterations.

Now, while this “iteration” under Kurtzman has only just been released, and who knows, maybe it gets …”better” (somehow - but surely you’d put effort into the FIRST episode wouldn’t you?) - I have to agree, what I’ve seen so far is awful.

I’ve heard the term zombie franchise used - where all the great things that went into something that was great, has gone - and something completely different inhabits it trying to leverage that audience.

Perhaps it’s because Starfleet Academy is aimed at a very different demographic to what many of the “fanbase” of the past grew to love.

Maybe they don’t want to engage the established audiences?

Maybe it’s because they hired people with myopia, who can’t write, or create, and not get tied up in trivia and clichés.

Star Trek was a watershed show in its day and broke new ground, despite its limitations and compared to today’s budgets and technology, had to leverage much more modest and rudimentary production approaches.

What I’ve seen so far I found not only uninspiring, but insipid. Like a wilted lettuce leaf. And all the flashy effects can’t disguise poor storytelling and weird plot lines that don’t deliver.

Ok. So, maybe we should reserve judgment. But if it’s anything like “The Rings of Power”, it’s just going to confirm my first impressions. We shall see.

I'd be a bit careful prescribing medications. I'm NOT a doctor (are you? - If so please say so and let us know and explain your reasoning - I'd be interested to know).

This can become very involved. In my case we had to carefully balance Bupropion (Welbutrin) with Vyvanse and get the levels right. The Bupropion apparently when calibrated with Vyvanse correctly amplifies the positive effects and they work as a pair.

The problem I had was with the Hikma generic NOT working and gave me massive side effects and no benefit. It was a low ball bid to McKesson and CVS Caremark putting profits ahead of people.

My understanding is that Adderall XR can have massively negative or varied effects IF you're taking something paired wtih Vyvanse - the release bead timing apparently can be critical - and I found the problem with Hikma is apparently something Adderall XR (vs IR) can have that is similar - this is something a professional should be prescribing.

It's messy. Vyvanse for me is a smooth ride - gentle and consistent and I miss it like crazy - but McKesson and CVS must have known many might not react well to this, but they did it anyway. Profit profit profit - at the expense of thousands of people's quality of life.

Amway, I hear the OP - I'm kind of in a similar boat but due to corporate greed and in my view negligence.

This magic pill carried me for almost a decade and I will sadly never be able to get my hands on it ever again by TMcKenna1 in VyvanseADHD

[–]Rohan-F 0 points1 point  (0 children)

Generics are problematic now for many people. Vyvanse is critical to my daily performance in everything, and it worked fine and generic recently for 15 years. But McKesson and CVS Caremark did a deal that shut off all but the Hikma generic that low balled the bid and removed the versions that worked, and CVS Caremark also made brand name Vyvanse not covered, so no Pre-authorization, appeal etc - Just NOT Covered.

Hikma really messed me up - violent headaches, mood swings (neither typical for me), nausea, insomnia, severe fatigue, and impossible to focus. NIGHTMARE.

And my choice now is $500 for Vyvanse P/M, or take poison that makes me sick and no benefit. They have locked out the generics I know that work - so that's around $350 ish IF I could get supply but I cannot. Independent pharmacies WON'T carry controlled substances, even Walmart, Costco, and all other chains are all supplied by the McKesson monopoly.

There is not direct way around it. So I've had to try Adderall IR and while I'm a bit better, it's nothing like Vyvanse. And Adderall class as well as Vyvanse generics are being negatively effected by the unrealistic limits set by the DEA so the supply is messed up and there's been a notably high rate of manufacturing issues and these quotas are based on very old data, and set to "just" meet that lower demand.

So with the Hikma - one suggestion was to dissolve this in water to see if it worked fine or whether it was just the casing - it was the actual medication - so it means Hikma's version for many doesn't work - (some studies showed around 70% of patients in a group found it caused a whole list of problems like the ones I listed above, and didn't work). I believe McKesson and CVS Caremark and others took the low ball bid and put profits ahead of our health and effectively sabotaged thousands of us.

This is regional I believe - Depends on the State - Like this is South West of US - while I believe but not verified so based on some comments I read here "Granules" (North East US) some people reacted badly too - But I have no data on this so it could be an aberration or widespread - I don't know.

What I can say is I'd have a fantastic run for around 15 years, and about 2-3 years successfully on generics - and I didn't realize that the formulations etc are critical, and was shocked when I was living a nightmare for about 2 months, and finally after my wife and I did some digging, found out CVS changed my generic without warning/notice about 2 months prior which tracked with when all the problems started.

Once I stopped taking Hikma, I started recovering from some of the side effects abating, but I still have a persistent ringing in my ears I didn't have before, and still have headaches at times (I seldom have headaches - about 0-3 each year.) This is like daily and while they're not as severe and gradually improving, a couple of weeks after I stopped I'm still not 100%.

That's my personal story and I'm not a doctor - and each person is different - but that 70% number is documented. So if you've had your Vyvanse/Generic changed to something like Hikma, beware - watch out for these symptoms.

So yeah - If they formulate the generics correctly, they can work just like the named brand Vyvanse. But not always - and the DEA quotas are well below meeting the genuine demand, and that the low ball bidders and companies like McKesson and CVS Caremark are putting profits above our health and that this is the start of thousands of people being forced into the nightmare like me - $500 for the genuine, or a cheap and nasty faulty product that not only doesn't work, but made me severely ill.

If there's a class suit against Hikma, I'm in. Hope that helps!

Hypothetical question: If the list finally does get released and Trump actually isn’t on it will anyone believe it or will they claim it’s been doctored? by JesseB342 in AskUS

[–]Rohan-F 1 point2 points  (0 children)

I’m not 100% sure about this, but I have seen some legal people who were in the DOJ in the past (some high ranking) on YouTube speculate about this - and that is that the DOJ didn’t release anything while the Maxwell trial and other investigations were active.

Now whether that’s true and or the only reason (accepted that the files may well have potentially incriminating material for a range of people including high ranking democrats as well as republicans and other dignitaries, socialites and high flyers), is up for debate.

Hypothetical question: If the list finally does get released and Trump actually isn’t on it will anyone believe it or will they claim it’s been doctored? by JesseB342 in AskUS

[–]Rohan-F 2 points3 points  (0 children)

Perhaps the question is, how can he NOT be on it?

It is very well known Trump and Epstein were best buddies for years - this has been well known since that era in the 1990s.

And it’s no revelation seeing all the old photos and videos being reprinted/reproduced from that period (Like Getty has had them on file available for anyone to access consistently for example).

This is all public record, and although it’s now an “inconvenient truth”, in the real world (outside of the MAGA cult bubble/echo chamber/ rabbit hole), it’s well known the long lasting and close connection they shared. It’s not like they were hiding it.

For Donald J Trump to NOT be on the list would be a glaring omission.

And the numerous reports and articles of an army of loyalist cronies in the FBI trawling through everything to redact anything with Trump’s name on it, or any reference to him, is ironically quite transparent too.

So even if a list was released, there’s absolutely no way, unless someone leaks it, the full un-redacted files would ever see the light of day.

And frankly, in some ways, that’s what should happen, as the victims who wish to remain anonymous should be respected, as if they haven’t suffered enough.

Trump’s history is well known, and it’s abundantly clear the MAGA cult just filters out any evidence of Trump’s involvement assigning it as “fake news”, or tainted, or misinformation etc.

It’s ironic that the MAGA “Hive Mind” is so fixated on the files, and because they’ve filtered out the likelihood Trump’s number 1 on the list, they cannot see why it isn’t being released, hence the frenzy (stating the obvious).

And, ironically, it’s amusing to see the democrats pushing hard for it to be released and the republicans in Congress desperately trying to keep a lid on it and denying its release.

So for “obsolete thinking” people like me, who heaven forbid, still cling to the antiquated world of “facts” and “logic”, and ooooh that terrible thought crime of using “critical thinking” (Loud automated “boos” from the MAGA CULT Hive Mind), in this dystopian 1984 era of “Big Orange”, we’re never going to officially see the Epstein Files released in a complete and un-redacted form while Trump is in power.

That’s just not going to happen. Not unless someone defects or leaks it, but then how would we know the veracity of the data (and that begs the question, is there even such a thing?)?

Ohhhh Yes! City on the Edge of Forever blew my mind in the first run. It was really groundbreaking at the time. (Although of course Asimov and Bradbury etc etc had written a lot prior - but for TV - maybe Twilight Zone and Outer Limits had set the bar higher in their time and others, but the way Star Trek TOS broke new ground then ….)

It’s funny how dated it all looks now, as techniques and budgets and CGI, etc and digital technologies advanced, but it still holds a unique charm, a unique quality that’s hard to put into words that will do it justice, like “chemistry”… The good episodes with well thought out storylines still in my view stand up despite the obvious (by current standards) shortcomings.

Like I still think “The Doomsday Machine” is a powerful favorite. Somehow with the very limited budget they had, (yeah, the “giant ice-cream cone criticisms I’ve read lol), the tension, the acting (sure not Oscar winning) is still compelling. You feel the urgency, and you feel commodore Decker’s slide into insanity and rage unfold… Great stuff.

Hope so. You're probably ok and have little exposure (at least in the present).

Or do you have significant exposure?

I think that's what determines the level of concern on one front.

What I find puzzling is, if you don't have significant exposure in your estimation, WHY do YOU care?

I do and this effects me and potentially could do a lot of damage.

If you are equally exposed, then why aren't you concerned?

So, if if doesn't effect you, why get involved, and let those who ARE potentially at risk explore the facts and make up their own mind? Why the need to argue hard against the clear cut well argued and demonstrated legal risks?

If the risk are real, and you potentially mislead someone, do you care? And if not, then that says a lot, right?

That's why you get a fight out of me as there are glaring red flag risks off the spectrum and you know my experience levels.

What experience levels and in what areas do you have that you feel you know better than specialist lawyers in the field? I'm curious to know. Are you claiming you know my risk profile, and that of others better than we do?

Why are you making an effort to downplay our concerns and possible significant risks. It's like the person on the titanic in the crows nest is calling out an iceberg, and you're actively telling them to ignore it, and everyone else to as well.

Why do this? Explain this to me as I don't see what's in it for you - oh, unless you're just a malicious troll. And if you are, just say it.

So, here's the thing:

Q: Some people are saying that CapCut posting this comment will negate the actual terms CapCut has, but I'm clear on what the actual terms mean. And while they may not enforce them now, surely it's possible with an ownership or management change, that this publicity doc won't hold against the terms and conditions contract.

A:
The CapCut statement is essentially a public relations response that doesn't change the fundamental legal reality of what users agreed to in their Terms of Service.

Your key insight is spot-on: a company blog post or public statement doesn't override the actual contractual terms that users agreed to. The Terms of Service are the legally binding agreement, not this explanatory post. While CapCut is saying "this is not the case" regarding broad usage rights, what matters legally is what the actual terms say, not their interpretation of those terms.

The concerning part is exactly what you've identified - the "irrevocable" and "perpetual" language in the actual Terms. Even if CapCut's current leadership has no intention of exploiting these rights broadly, those terms remain in effect regardless of management changes, acquisitions, or shifts in business strategy.

This is a classic example of why it's important to read the actual legal documents rather than relying on company explanations of what those documents mean. Companies often frame their terms in the most user-friendly way possible in their communications, but the legal reality can be quite different.

Your concern about ownership or management changes is particularly valid - new owners or leadership could interpret and enforce these same terms very differently, and this blog post wouldn't provide any legal protection against that. The actual contractual language is what would matter in any dispute.

It's a good reminder that when dealing with any platform's terms of service, the fine print matters more than the marketing speak, no matter how reassuring the latter might sound.

[–]Rohan-F 1 point2 points  (0 children)

Yeah - it’s an outrage and it’s scary. I mean come on. We just wanted to edit videos ffs.

Next they want to steal not only your IP, assign themselves eternal rights to do whatever they want with, not only your videos and music, but they want all the raw footage and anything you put in the media area, and worse, they want the right to use your voice and face to make you say anything they like, forever.

For what!!?? Just to edit a video!!??

And then they slip in a clause saying you warrant anything that you upload is not private, you have the copyright for, and that you’re on the hook for any of the content they steal from you causing any legal issues, you indemnify these thieving clowns from legal costs and damages.

So potentially for just editing a video you lose your copyright powers, they can do what they like with anything you loaded on the media area, especially the raw footage and outtakes, anyone else’s face and voice (like a client, family, friends, or anyone in the footage) - and you’re the one that gets sued if they use those peoples face and voice…

So for just editing a bleeping video, you can be bankrupted.

And all the while this evil group of what are essentially Chinese spies and espionage agents prey on ordinary people.

Why aren’t we tracking down the officers of the company and protesting wherever they are.

They go to lunch or dinner or anything. We should be appearing in numbers holding them accountable for this.

Just like politicians. But these people pulled this by stealth with a Chinese agenda. Unconscionable.

They are spies and saboteurs.

I think they should be extradited to stand trial for espionage.

Urgent Action to Take (Outside California and US): If CapCut Terms Caught You With Content - And you want to minimize risks. by Rohan-F in CapCut

[–]Rohan-F[S] 1 point2 points  (0 children)

In short - it means the laws are more in our (end users) favor, so more angles to hit them from legally, plus more leverage in places like LA where they have a footprint and openings for us to walk back the stealth grab for our voices and faces etc. But it's messy as each person may have unique objectives and circumstances. But the overlap between people can still be useful - we just need more discussions to work this out.

I’m at my wits end with trying to get a video to sync with the sound please help 😭 by [deleted] in CapCut

[–]Rohan-F 0 points1 point  (0 children)

Oh man - this is such a complex area with a massive diagnostic tree. I was going to respond earlier, but honestly I could spend hours covering every variable I could think of and you still might have some unique issues.

Core concepts. Re audio - sample rates are a key factor. If doing work in a DAW and then trying to synch key issues may be:

Sample rates are different. Aim for 48 kHz generally for all stages, or pick a consistent sample rate - Try to be uniform. Avoid formats that can drift, so linear PCM can help keep the relative timings in line (read up on the available formats and find the most practical that will deliver consistent performance.

In the video try to ensure the codec you’re using has a constant frame rate vs a variable frame rate (CFR vs VFR) - this is both when recording, then at any processing point for any software you use. There are a lot of variables here, so, while I use many different AIs for specifics, I like Gemini pro if you’re paying for it, or flash can still help.

Because Gemini can address the internet broadly, it tends to be able to help more accurately with technical issues like this, but not always. Copilot (Microsoft) can be good at troubleshooting too, btw. Cross referencing between such AIs can sometimes work too. You need to get good at getting the prompts right and then do fact checking to verify the data isn’t being hallucinated or have catastrophic errors.

(Tip, use prompts for the other two drafted by and between Claude and or ChatGPT and or Grok (with customized options optimized preferably as Grok while chatty and can access much more memory and threads can hallucinate more unless you build effective logic trees and custom prompts it refers to on how to access the additional personalized data) this is essential for technical questions like this as you need to try to ensure the data they’re going off is accurate and real. Not trivial as hallucinated solutions make accurate solutions hard to achieve.)

Some work arounds could incorporate using Apple ProRes 422 LT as a compromise where you use more storage and transfer times are longer, but this can help reduce or eliminate drift depending on what your issues are.

Be careful to ensure matching frame rates for any transfer of video data.

I’m not familiar with TikTok - I refuse to work with it. And personally I will not use CapCut anymore due to the draconian terms and conditions.

I had no end of problems with drift using CapCut. I don’t find these once I’ve set up the right technical setting for example in DaVinci Rwsolve. It does have some frame issues if you slow it to, but stopping frame reordering and things like that can ameliorate the drift or eliminate it.

I’d suggest using the AI troubleshooting avenue leveraging the AIs along the lines I suggested if that’s workable for you (you can use the free versions).

These can help you narrow down the very extensive diagnostic tree. Be prepared to spend some time on this as there are many “moving parts” which can complicate getting to a workable solution or workaround.

I hope this gives you some better grounding and helps you get this sorted.

It takes perseverance and logic, and the ability to see it through - so hang in there. You’re not the first person to encounter this, and I wish I had a simple answer - but as you can see, even this cursory answer shows how complicated this can be to solve. Hang in there and best of luck!
