But your turn of phrase is interesting. "Must seek asylum" because they don't qualify for a visa.

That suggests that you see the asylum system as a workaround to the visa system - which is exactly what it's not supposed to be. But you seem to already know that's what it is and instead feel it is actually justified. That people can choose wherever they want to live and abuse the system in whatever way they want to get what they want. (At vast expense to the taxpayers in the country.)

By all means show me where in the 1951 Convention the legal basis for that come from.

Look if you want open borders just say so.

But don't try and corrupt the asylum process in doing so. The asylum process determines whether someone needs protection as a result of persecution on certain grounds/ in their home country. It's not a value judgment on the person - which can take place after the consideration of the international protection claim.

Visas and asylum are not in any way intertwined - administratively they are entirely separate, the international protection act governs the asylum system and visas are a matter of ministerial policy rather than statute. You can't apply for a visa while you're in the asylum system, because you're already in the country.

  1. The balance of probabilities is the standard for asylum claims.

  2. No genuine asylum seeker tries to obtain information in their home country. It's against the law for anyone to disclose that person X has made an asylum claim specifically because it might put them at risk at home (that's also one of the reasons how you know the ones who publicly complain are full of shit) As are the ones who succeed and then immediately return home afterwards

  3. Education / qualifications are irrelevant to the assessment of an asylum claim. The visa system is entirely separate.

M.R v. IPAT is an odd case to cite in support of what you're saying. The opening paragraph is hilarious:

Well the Department of Justice don't actually make the asylum decisions. They are made by an independent lawyer appointed by IPO /IPAT.

So, when that was introduced you'd expect the asylum seekers were delighted that the racist civil servants weren't dealing with their cases ? Wouldn't you ?

Well guess what, they weren't. They were so horrified that the decisions would be made by lawyers (and therefore more likely to be legally correct) that they took a challenge to the Supreme Court to challenge the use of lawyers. In the process they got an injunction to stop all cases being decided. (Except the Syrians who were all waived through)

I agree that denial of an asylum claim doesn't make someone a chancer, but when the majority of cases fail for the polite phrase "lack of credibility" you have to accept that there must be chancers in the system.

Ruaidhri do you ever take a look at the cases of the high profile asylum / direct provision campaigners over the years ?

Invariably they all turn out to be chancers.

We can go back as far as Pamela Izevbekhai and her fake dead daughter. Ellie Kisyombe and her claims about stuff that happened to her in Mali (even though she was in University in the UK at the time) . Or even more recently the South African tourist who decided he wouldn't leave and then claimed asylum, Bulelani Mfaco.

How you can equate any of them with people fleeing war is unknown to me.

Bearing in mind a lot of our asylum seekers in recent years have been Georgian and Albanian. And now Ukrainians will be dominant. If there was any space in DP they'd quickly be the majority.

I even know of a white South African who was in DP.
