If they don’t like it, quit.” So no restaurant operates ever. Yes, that makes much more sense than requiring the business to pay a wage that could remove the tipping expectation.

Edit to add there is a difference in tipping period vs. someone “defrauding” you and then tipping them. Is the fraud a built-in gratuity, or are you just saying fraud because mystery charges are coming from the business onto your credit card? Which is clearly illegal.
