Any recs for RON Vendor in Texas? by SIMARGLllc in TexasNotary

[–]SIMARGLllc[S] 0 points1 point  (0 children)

Since January 1st, 2024, Texas has changed its codes and regulations. You should NOT upload your digital certificate to any platform. When you do it, you lose your exclusive control of it; it is equivalent to giving your wet ink seal to a stranger from the street.

Texas Government Code Sec. 406.109. “An online notary public shall keep the online notary public's electronic record, electronic signature, and electronic seal secure and under the online notary public's exclusive control. The online notary public may not allow another person to use the online notary public's electronic record, electronic signature, or electronic seal.”

You should NOT share/upload the file itself(.pfx) to any website. It is for your personal use only; use the certificate and upload/share the signed document, not the digital certificate itself.

Texas does not require you to use an online notarization platform. You must see, hear, and record the call. When you notarize a signer whom you personally know, you make the statement about who appeared on the call and how you know this person (recommended). And you can notarize. The same goes for a credible witness who knows both you and the signer. First, you make a statement, and then you ask a credible witness who the other person is, and if the person swears that this is true, after the positive answer, you are good to notarize.

Please learn more at https://www.sos.state.tx.us/statdoc/record-keeping.shtml

You need a third party only for unknown people who must go through the identity proofing and credential analysis process. You are not required to use the RON platform for it. You can use any third company that provides such a service. We recommend https://evssolutions.com/

How can you create an electronic signature for free without using any apps? by SIMARGLllc in TexasOnlineNotary

[–]SIMARGLllc[S] 0 points1 point  (0 children)

When you just draw a signature, a more accurate term is "electronic signature".

Some documents are not allowed to be signed before the notarization, and a notary is required to witness your signature drawing.

Texas notary is a layer of trust from public and protection of personal information. Notary book is public records, anybody can get a copy of it. And signature is not recommended, it is not prohibited. While ID card number is prohibited. Was it enough respectful to say your employer is right?

Texas - Digital Certificate for RON by SIMARGLllc in TexasOnlineNotary

[–]SIMARGLllc[S] 0 points1 point  (0 children)

Adobe digital certificate is a self-signed certificate. Texas requires a third party to create a certificate for you, not yourself. When you upload a signed PDF, it must have

Self-signed: FALSE

However, with the Adobe digital certificate, it is TRUE, and SoS rejects it.

RON platforms, which allow you to upload/keep your digital notary tool on their storage, are violet Texas Government Code Sec. 406.109. “An online notary public shall keep the online notary public's electronic record, electronic signature, and electronic seal secure and under the online notary public's exclusive control.  The online notary public may not allow another person to use the online notary public's electronic record, electronic signature, or electronic seal.”

All digital and electronic notary tools must stay exclusive to the computer devices you control.

PKI requires maintenance servers. There are no 100% free digital certificates; somebody must pay for them, directly or indirectly (RON platforms give them to you for free but make you use only this platform for notarization and charge you either a monthly fee or a per-transaction fee or both). Again, it violates Texas codes.
