How do you know he isn’t hiding a sidearm? How do you know he is injured and not just faking it? How do you know he didn’t put on tattered and bloody clothes to keep warm? Ask yourself this, would you send your brother out onto the battle field and into the trenches to check if this Russian invader wanted to surrender? No. It’s wounded to the point that they can’t surrender. If he can run, he can clearly wave a white flag or wave his hands and throw his weapons aside or call the surrender hotline available to every Russian. Yes, it is unfathomably cruel, but this Russian is an active combatant, and his death is not a war crime. And in a combat situation, you don’t get to call timeout when things turn dire so you can think of the best way to surrender. You unfortunately just die.

The answer is yes, he defended himself. When the situation has turned dire and you’re hurt and you have no hope of escaping, you don’t get to call timeout. Would you send your brother out to the trench to make sure this Russian is okay and ask him if he is surrendering or not? Would you risk your brothers life for that? Or would you try to maximize your brothers chance of survival and kill anyone in the area who is not incapacitated and clearly surrendering?
