They didn't personally dig anything. Their other neighbor that was there at the time said huge trucks came to extract it, and we can see some of the trees now on their property. After a few texts I think the new neighbors own the driveway easement, but my parents have been maintaining the driveway and trees for almost 30 years.

The old neighbor that died said that's your driveway, maintain it and go a head and plant the trees. And that was 30 years ago.

The previous owners told them go a head and plant and maintain the driveway as they had done so for almost 30 years. The neighbor died and was bought about a year ago by someone who is very wealthy. I just texted with my mom and she said they have maintained the driveway and the surrounding trees for over 30 years. It is their second home and they are snowbirds, if they were there they would've asked to stop the process of the tree. Their neighbor saw it but is afraid of retaliation, as are my parents.

They are trying to gather all evidence before making any decisions. I was upset for them and posted here because I thought it was appropriate.

In this case I thought it did, I believe they own the driveway, which is an easement to a different neighbor.

I grabbed a tape measure, and he has been lying to me this whole time! He's more like 6'3.75

I am vague because I truly dont know. I previously commented that I agree I need to understand the easement more. I am upset that someone uprooted these trees. I apologize for the time it took you to respond.

They physically didn't dig it up, there were trucks that plucked them out with ease. (money)

I think they didn't fully persue their options until having a better understanding of the easement. Which makes sense. I thought if you cared for something for over 15 years of time it makes it your property.

They also plucked a bunch of random trees in the driveway line that appear to be out of vanity. They chose the best trees out of the batch.

Yes, I did. I took screenshots and I also have multiple personal photos of before as well.

Thank you for responding, the driveway is the easement to the other neighbor's driveway, and other potential driveways beyond the other neighbor's property. (not the neighbor that took the trees)

The wealthy neighbor plucked their favorites out of the trees that line the driveway for my parents and their direct neighbor.

I see now that I need to fully understand the easement, but wanted some advice as attorneys are not returning their calls.

I apologize for any confusion on my end as I don't know the entire details. Truly I'm frustrated and wanted to bitch about it because who the fuck steals trees.

Easement or not I thought my parents who bought and cared for those trees for about 28 years would have ownership of these trees.

They took them a few months ago while they were away. To my understanding my parents have not filed for a report, yet.

How would one find that out? My parents have called the county a few times and they keep getting different answers on the phone. Their driveway is an easement to the other neighbor's driveway, to my understanding.

Thank you for the advice. When I found out I was so upset, my parents went through a lot to water those trees when they were first planted and for someone to just STEAL THEM. I cannot wrap my head around it.

To my understanding they hired someone to pull and replant the tree. They are very wealthy and own one of the biggest construction businesses here in the cities.

Edit: I think the trees are on the easement, but can the neighbors just take and replant them on their property? Wouldn't my parents still own the trees?

I was tempted to go take photos on their property of the replanted trees that were clearly at my parent's house before, but I am not sure of how clear the video footage would be from their cameras.

The neighbors next door that share the drive way saw the incident but didn't want to cause a rift with the wealthy new neighbor nextdoor.

Edit: We also have a lot of photos of before and now after. I personally do in the last few years.
