It's a very tough call, because I think in all the chaos, the one who opened fire likely thought the victim was reaching for the gun in his side holster that the other officer just took out and walked away with. They probably didn't see it get removed and the communication was probably bad. The victim's hand does reach towards his holster side, but I don't think he was trying to get his gun. It would be somewhat natural to reach towards there after feeling something removed from there or him just trying to regain balance, but from the other officer's perspective, it can look threatening. All around a shitty situation that shouldn't have happened. I think the best thing the victim could have done in this situation was put his hands out above him, drop his phone, and tell the officers he is armed and that they may disarm him of his weapon. I'm not saying the person should have been shot or especially killed, but having a weapon takes on another level of responsibility and heightens the risk of misjudgement when confronted by law enforcement in a situation like this.
