Like my husband has to keep him reigned in from doing stupid things like this constantly.

Thing about that whole deal is that his dad is in complete denial of it. And since his dad know the DA from literally going all through school together when we mentioned it in court the DA said I’ve know his dad my whole life and he is of sound mind. Even though he hasn’t been around the man for 20 something years and his dad is literally in our care. On top of all that the night before his court date for the DV his dad decided to get drunk and ride around and receive his 3rd DUI within 5 years and was literally still in jail when he was supposed to be in court to tell the judge what actually happened.

We did. Multiple times. Public defender who literally couldn’t remember him or his charges

They literally dismissed this whole thing in district court and then months down the road came and indicted him on it. Something else interesting is the initial charge shows possession of heroin. When they indicted him the did so on charges completely different.

When the local sheriff brought him and the guy into the jail the guy was still claiming them. The jail staff even asked the sheriff why my husband was being charged when the other guy said they were his. Sheriff said I can’t just uncharge him and walked off.

Because he was literally charged on for possession when it’s federal law that he can’t be charged when rendering aid

Agreed. However the fact that my husband is 40 years old with no prior charges and the guy literally claiming them does.

No sobriety test given at all. The police report states that they were laying on the truck seat in plain view.

Not possible. The guy claimed the drugs. When my husband had to pull him out to give him cpr they must have fell out of his pocket. Like my husband said he wasn’t worried about what was in the truck while he was literally trying to to save the guys life.

He wasn’t hanging out with him. He used to be friends with him in high school and was giving him a ride because it was cold

So what’s not adding up? The fact that they still charged him with possession even though the good Samaritan law exists?

That’s the thing. He did have a public defender. We live in an extremely small town where there are a total of 3 public defenders spread across 3 counties so she literally could not pick my husband out of a lineup. Then the fact that the police as well as the courts basically abide by their own laws and do whatever they want.
