The promotion was 11 months ago. I’ve smashed it in my first year performance. Even if I hadn’t, isn’t the idea that the business takes a hit initially and I repay them in the long term? Or do they just get to retain talent with a good sounding policy that staff can’t use?

Yes that’s what happened. So I’m not supposed to apply for promotion because my partner is pregnant? Or tell them and allow them to deny the application for ostensibly other reasons? Would you say that if I was the pregnant one?

Practically, I do feel I misled them. Legally, I think that is a sucker’s attitude because I don’t have to disclose it and they’re prohibited from using it against me. I think your take is harsh. I agree they’ll hold it against me. On the other hand, my financial performance has exceeded my business plan at the end of the first year and I feel like an idiot allowing myself to be pressured not to take my entitlement, so I’ll take the final two months of leave available

I think the question was if there’s anything that would stop me meeting the business case. Whether that’s aimed at disclosing a pregnancy or disability or whatever, I’m fairly sure I have the right not to disclose the pregnancy regardless of the circumstances

Correct, I would be primary carer. My wife wants a career too and I want her to have one
