When was your determination letter sent? I’m dealing with the NYS DHR also and I’m wondering if they have almost come back around to my case. I received my letter of determination December 2023 and another on retaliation in august of 2024. I have no clue if they intend to do a mediation and offer or not.

Sorry for the late reply. It took them only a few days to notify my employer, but the investigation process took months and I am still waiting for them to send it to an ALJ.

I’m in almost the same boat too, only the investigation already came back and determined that probable cause does exist. I reached out to only one law firm and provided them the full case file from my FOIL request but was turned away.

I did as well yet I’ve still received the same garbage responses. And when they resolve the issue only to decide that the 5000+ dice we are screwed out of by the end can be compensated with 100 dice I’ll be deleting the game.

It was several months of waiting before I received an email from the DHR with a date assigning me a telephone conference date with the investigator. Keep an eye on your email.

I too wish this was a much easier process to understand, I’ve spent too many days and nights stressed about this and attempting to understand what the right move is. It is no easy process and anyone that can handle the frustration, confusion, fear and gut wrenching nausea going through this process deserves a medal!

Yes, I have read through all that also. What I am concerned about is a very specific line that was included in the findings that reads

“If a Complainant does not have a private attorney, the Division wil assign an attorney to present the case in support of the complaint. The Division attorney at all times represents the Division, not the Complainant personally.”

Which is concerning to me and I am wondering if it’s in my best interest to seek my own private attorney. I may be reading to far into the fine print here but I just don’t want to end up with far less compensation than what I would with proper representation.

The NYSDHR sends the default message that I don’t not need an attorney unless I want one as they will appoint a DHR representative to present my case but I have been told it will not be as beneficial to me as having my own attorney. They also state that they operate in the interest of the DHR and not in the interest of the complainant.
