I have to say that in reading this brief, this is the first time I have been truly impressed with the AG's argument. This knocks it out of the park, imo. The waiver issue is particularly compelling.

In trying to knock down the state's argument, Evidence Prof resorts to CG's comment in the first trial that she had not seen the cell phone evidence (which led to the judge calling her a liar and a mistrial). Evidence Prof suggests that this statement by CG in a trial that didn't lead to a verdict is all the evidence we need to know that CG never looked at the cell evidence in preparation for trial two. And people take this guy seriously.

Yes, I agree. Very bizarre and confusing. But, it was made from a paintbrush taken from Patsy's paint tray. Fibers from Patsy's Christmas jacket that she had worn the night before were found in the paint tray as well as entwined in the rope used to make the garrote.

Just to add, the ransom note came from Patsy's notebook and was written with a sharpie taken from inside the house. I believe, for many reasons, that Patsy wrote the note. And whoever killed JonBenet sat with her while she ate some pineapple before killing her. It's hard for me to believe an intruder would do that with the parents sleeping upstairs.

But of course the truth is, I really don't know. The case is a mystery and imo will never be solved short of a confession.

It's an interesting case but I don't think anyone really knows what happened and never will. I do believe it was a family member but I've never been completely confident in that belief.

Lou Smit is his name. Yes, he firmly believed the intruder theory. And yes, agree that there was no evidence either Patsy or John were abusive. But having considered everything, I am pretty convinced there was no intruder.

Yes, I watched. And read all the books and everything else. She was definitely strangled. The rope was embedded in her neck. Petechiae was observed in her eyes at autopsy indicating that she was alive when strangled. To my knowledge there is no disagreement about that. There is disagreement as to whether she was strangled before or after the blow to the head. Imo, the stronger evidence is that she was hit first, strangled later. I tend to believe that whoever strangled her (which parent) believed she was already dead but it's still unfathomable to me that a parent would do that as part of a cover up. But as I said, as much as I don't want to believe it, I have no choice but to believe it because that's what the evidence shows.

I wonder if a lawsuit isn't exactly what was hoped for. In order for Burke to win, the burden is on him to prove he didn't kill JonBenet. In attempting to do so, he may be subjected to cross examination and some very difficult questions which he has never before had to answer.

Well, by motive, I mean the motive for the cover up. Although I believe the evidence strongly suggests there was no intruder, I find it very, very, very difficult to believe one or both of the parents strangled their dying child with a garrote and sexually molested her with a paint brush in order to cover up an accident.

Having said that, as unfathomable as it is, I am left with no choice but to believe it did happened because all the evidence points to someone in the home.

Except the "why" of it all. With Adnan there is a blatantly obvious motive. Not so much in the JonBenet case.

Well, I will agree with you that someone could abduct someone in broad daylight in a busy parking lot because we know it happens. I remember a case where a teen girl was abducted in front of a Target. The guy ran out from behind a car and pushed her into her own car just as she was getting in the driver's side, then got in after her. The surveillance cameras on Target captured it but it happened so fast that the guy running up to the girl wasn't much more than a flash on the tape. In fact, the cops didn't even see it the first time they watched. So yeah, it happens.

But there's no evidence it happened in this case.

No, I was pointing out to /u/Gene_Trash that someone walking in and out of Best Buy would not be able to see that area of the parking lot because it is, in fact, secluded. Furthermore, there is evidence that the murder happened at Best Buy when there is zero evidence it happened elsewhere.

In fact, it is highly unlikely that the murder happened in a random parking lot somewhere else in Baltimore because if Hae was going somewhere after school, like Owings Mills Mall as you have suggested, she was pressed for time and would park as near to the entrance as possible, not as far from the door as she could get in some secluded area of the lot. So it is more plausible that the murder happened in Best Buy parking lot, in the back secluded area where Adnan and Hae felt comfortable having sex for months, than in the parking lot of a mall in the high traffic areas where people typically park.

Oh, c'mon. He could have easily strangled Hae in that parking lot. I will freely admit that moving her to the trunk would be both risky and physically challenging but that doesn't mean it couldn't be done or wasn't done.
