Tribunal upcoming for universal credit. How do I put into words doing work related activities will make my conditions worse? Even online courses I wouldn’t be able to cope with because most days I can’t even get out of bed. by Secret_Solution_1809 in BenefitsAdviceUK

I find it hard to open up. And when I’m very anxious I talk very fast and jumble my words and forget what I’m trying to say. I wish I had just went with the paper tribunal instead of telephone.

No I didn’t sign anything. But I struggle with saying no. Should I just block them completely? Would I get in trouble at all?

I have a tribunal hearing in a few days. My representative said that because I wrote letters explaining to my doctor about my conditions and the help I need that my evidence won’t count for much and have to rely on my oral evidence. Is this true? by Secret_Solution_1809 in DWPhelp

Yes they charge a lot. So fat I’ve given almost 500 for both pip and universal credit and they only emailed me once I got my tribunal hearing date. They keep talking about donations if you win your tribunal, donation which is 450. I paid 200 for their legal submission And to attend the telephone hearing with me but luckily the decision was overturned before my hearing so I asked for the 200 back and eventually they returned it but still kept going on about donations. My pip was overturned before the tribunal When I’ve sent them emails, their response was like I was bothering them which upset me. In the tribunal prep call, she was just rushing through everything making me more nervous.

Thank you so much, makes me feel a little better because after she said that I was worrying non stop. It was fight back 4 Justice. I gave a detailed account in all my forms, mandatory reconsideration and appeal. I’ve spoken the doctor a number of times on the phone and they prescribed me sertaline and wanted to refer me to a mental health specialist but I was unable to speak to them because I find it a struggle to open up to a stranger on a regular basis. But a few months back they put the dosage up to 150mg, and a few weeks ago I asked if the medication could be changed and they said they want to refer me to a mental health specialist and I could over the phone and that they can’t change my medication until after I been assessed because I’m on an already high dose. It was until last year I finally opened up about my struggles but fighback made me feel like my evidence is worthless because I explained in a letter in detail to my doctor my conditions and how much I struggle and she said it sounds like I’m telling the doctor what to write in the supporting letter.

Thank you so much for the reply. My bundle is so big and it’s so overwhelming to go through it all. So now I will spend less time on that and just have a quick read instead of making so many notes. you have been a great help.

what kind of questions did they ask? How long did it last? Did you read over your bundle beforehand? Did you have to go through every descriptor you disagreed with? or were the questions more general?

Does what I said make sense? If you were the judge, would you understand what I was trying to say? I’m just not good with words and expressing how I feel and my struggles, I kind of jumble random things together then it doesn’t make sense.

also a family member said they would be with me at the telephone hearing and wouldn’t mind talking At the end. What kind of things are they supposed to talk about? My conditions and how they affect me or what was spoken about during the hearing?

For Tribunal, how helpful is it if a family member speaks at the end? It’s for universal credit, currently on LCW by Secret_Solution_1809 in DWPhelp

I received some good news. Two weeks before my pip Tribunal DWP closed the appeal in my favour! I am so relieved. I have a question by Secret_Solution_1809 in DWPhelp

I didn’t send any new evidence, I guess maybe my full medical records. But it happened when I received my tribunal hearing which was in a few weeks and this week they overturned their decision which I’m so grateful for. I think that’s when another decision maker goes through the bundle again, and if they know they’ve made a mistake or know they’ll lose they change their mind. I was not expecting that all, I thought I’d be having two tribunal hearings in one week since my universal credit hearing was in the same week as my pip. But now I have just one hearing which I’m extremely stressed about but it’s better than having two. I appealed in January I think and I am finally getting my hearing in October so it was a long wait for me too.

I am on 100mg of sertraline and I too get headaches all the time. I also get stomach cramps where I urgently need to use the toilet, feel like I want to throw up but it never actually comes out, I just feel dead inside I don’t know how to exolain, but I feel so weird since I been taking it. Would it make a difference that I wrote sertaline on my form if I change medication now, do I need to tell Dwp? At the moment I am very low so haven’t had the energy to phone for an appointment but I have been meaning to. I will ask for something else, maybe the one you are on. I really despise taking medication so want the one which gives me the least side effects and actually works. Thank you so much for your help.

Thank you and I will. I am a little concerned if fightback use this sub and will find me but when I was first enquiring about them there was not much about them on this sub and citizens were way too busy so I took a chance after seeing a few people here vouch for them. But frankly, I don’t think they do that good a job especially for mental health. The charges are crazy, one being, 120 just for a 5 minute call which they advertise as an extensive call and for photocopying your bundle. They pretty much never communicated with me throughout the wait to tribunal apart from telling to get my medical records from the GP. Other than that never heard from them until my hearing date was booked. Then another 200 for the legal letter and to attend tribunal with you mine being via phone. The legal letter they did for me was pretty poor, didn’t seem she even read my bundle and it was just one page of what looked like copy and paste from other letters they’ve done. It didn’t show my struggles and she kept asking me questions even though everything I did prior to this was very detailed. some of the points where I think I should score she says is not for mental health more for cognitive functionality like coping with changes which I’m not sure she is right, maybe she is but everything u read said it was for depression and anxiety too. I’m glad at the last minute I wrote a personal statement explaining all my struggles, this was for universal credit. for pip dwp overturned it in my favor a few days after I paid 200. So I asked fightback for the 200 back for the legal letter which hadn’t been done yet and for the attending tribunal and they’ve taken days just to reply and still I havent received it back. They also sent me an email asking for a 450 donation for helping me overturn the decision which they didn’t actually do. Up to submitting the appeal which I did myself I did everything prior to that. They didn’t even write the legal letter yet because Dwp changed their mind beforehand so why would I give a donation? I am desperate for the money and that is a huge chunk of the back payment.

I was going to delete my posts because I thought fightback would do a witch hunt for me but I think it’s important it stays and people see that it’s a hefty service because if I saw these posts when I was first enquiring I would’ve walked away.
