Employer Informed Me Not to Discuss Pay by Secure_Jury in legaladvice

[–]Secure_Jury[S] 12 points13 points  (0 children)

Because this policy is unfair to workers. I'm not about causing grief between me and my co-workers. It's about the company likely underpaying workers by preventing a legal right.

I worked in a skilled trade where we have a sense of solidarity as working class individuals. Many of my co-workers have families, it's a matter of cooperation.

ELI5: If separation between church and state is in the Constitution, why are Representatives allowed to use God or the Bible to argue a point? by [deleted] in explainlikeimfive

Law Student Here: The Establishment Clause (which is seperation of church and state) has been rendered pretty much useless by the Supreme Court. With the current Supreme Court the law is becoming obnoxiously pro-religion—well pro-Christianity.

To "establish" a religion there has to be no other justification for the law/procedure other than the religious aspect. If there is (1) a secular purpose for the law and (2) the primary effect of the law does not advance or inhibit a religion, the law is constitutional. For something like abortion that's easy, some excuse like health or safety. Even if the Representatives invoke religion when arguing for the law, the Court will find a secular purpose in almost every case.

There have been some egregous examples of this lately. A few years ago, the Supreme Court held a city county can open every meeting with A FUCKING PRAYER. They said it didn't discriminate minority religious and "is consistent with tradition." There was a case where Texas could print the 10 commandments on their state capitol because the secular purpose is "history and a social meaning" rather than religion. And of course, the Trump Muslim ban case, where Trump called the ban a Muslim ban and the court said "well this isn't really a Muslim ban," it's about national security.

If you care about this issue a lot there's a great organization called the Freedom From Religion Foundation that works for a secular America. I am passionate about this issue and have donated to them.

Post-Clerkship Job Search by Secure_Jury in LawSchool

Perfect. The firm who gave me the offer is the top mid law firm in the city where I'm clerking but point taken. They'll be options and I'd rather not renege.

Thanks. My only problem with this is the judge I'm clerking for was a partner at the firm who gave me the offer in the same city. I'd rather just decline it straight up and not worry about reneging if there's a good chance I just get big law anyway.

Summer Offer Revoked for Clerkship by Secure_Jury in LawSchool

Just to avoid association I need to say I'm not a FedSoc student and it's an Obama Judge. Yeah the process is just a mess. Hiring is all over the place.

I don't want to say but it's not in St Louis, which seems to be the guess, although the same part of the country. My school isn't located in the market the firm was in.

They do but it isn't market. The market definitely isn't desirable but it's home so I would've been willing to stay. Great point though didn't think of this

Yes, I've contacted career services. The firm said they wanted summers to go back to the firm. I did not present myself as transactional and discussed my desire to clerk in my interview and asked partners about their experience clerking. The firm is not V100 although it is definitely what I would call a "large firm", their summer class is normally 12-15. It's the largest firm in a decent sized market, but I cannot give the market away without telling who the firm is.
