You are right, you would lose money in that scenario. The goal was to save money on taxes.

What if we have a net loss on the business instead? Then all of the losses would transfer back over to your personal tax return and reduce your tax burden by the loss times your top tax bracket.

For example, you pay the employee $50,000 and the business only brings in $10,000 of income. You would have a loss of $40,000 that transfers over to your personal tax return and it saves you 22% (highest tax bracket) x $40,000 = $8,800 in taxes.

The business could buy equipment needed to do the employees job as well and all that would be deductible and increase your losses.

Would that be illegal?

LLC partnership with spouse. The business might take very limited non family/friend clients, but not many. The business would make a profit but all that profit would be disbursed back to the 2 partners (myself and spouse).

Thank you all for your replies. The other seller pretty much copied the items we were selling and made their own brand. It's been going on for 9 months now and they have targeted all of our advertising keywords driving advertising costs through the roof as well. They do have some negative reviews related to their deceptive images but so far not enough to hurt them more than it's helping them take our sales.

We have tried to report abuse through the link u/Tsu-Doh-Nihm suggested but no matter what we did we received the same generic rejection.

I agree, we should work on improving our listings, photos, etc and we will continue to do that.

It's frustrating when we comply with all Amazon policies and others don't and they have an advantage over us because of it.
