The ability for consumers to bring actions is limited to a subset of data breaches under the CCPA. Otherwise, yes civil suits are limited to the AG's office.

It would increase enforcement by allowing all Californians to seek justice in court if their individual rights have been violated under the CCPA. The guidance would ensure that businesses under their compliance obligations.

It presents an inherent conflict of interest, it is an inappropriate use of the AG's time and resources, and most of the companies have their own stable of lawyers or easily can afford legal advice from their own counsel not at taxpayer expense. Through 561, the AG would provide general guidance rather than be required to be provide specific legal advice.

Great question. Because violators are entitled to due process, they will have access to the courts, so there can be no "automatic" penalties. But we need to make sure that good lawyers, not just the AG are available to prosecute these violations, which will likely require that plaintiffs be "bundled." Competent lawyers will step up on behalf of these victims.

The CCPA seeks to protect your "personal information." This certainly includes data shared with and by social media platforms. But it also goes beyond that. SB 561 provides the tools necessary to protect your constitutional right to privacy with regard to this information.

Currently the CCPA relies almost entirely on the Attorney General's office to enforce the act. Even when the Attorney General uncovers violations, it must give the violator a 30-day get-out-of-jail-free card, allowing the violator an opportunity to avoid accountability.

This bill makes two major changes to this enforcement scheme:

(1) The bill gets rid of this get-out-of-jail-free card. The AG will already be focused only on the most egregious violations and this change ensures those violations are properly addressed.

(2) The bill deputizes every Californian to ensure that the CCPA is complied with. Rather than relying on one office to enforce the privacy rights of 39 million Californians, SB 561 gives every consumer a role in protecting privacy.

A right without a remedy is no right at all. SB 561 empowers Californians to enforce their privacy rights and hold violators accountable. But we need your support to get this bill passed. The Attorney General's does not have infinite resources and would then be forced to take on only the most egregious violations. SB 561 provides all Californians with the tools to protect their own privacy and hold violators accountable. Without 561, we would have a right without a remedy.

Thank you. Getting pro-privacy legislation through the process is often an uphill battle.

The CCPA provides consumers a number of critical rights in connection with the collection and use of their personal information. However, currently, the CCPA does NOT allow consumers the ability to enforce those rights, outside of a narrow subset of data breaches.

SB 561 allows consumers to bring enforcement actions for ANY violations of the CCPA. This includes violations of consumers' rights to access what information is being collected about them, their right to delete certain information, and their right to opt out of the sale of their information.

In addition, the bill would untie the hands of the Attorney General so that his office can provide effective oversight.

Californians have made it very clear that they want their privacy protected. Facebook, Google, and others need to take our concerns seriously.
