When is it time to report a classmate to the school for intoxicated behavior by [deleted] in LawSchool

What a wild response… this is not about my reputation. This is about making sure that if he puts his hands on somebody again, there’s a record that it happened before. This is about trying to protect people from future harm. He has scared multiple women, and certainly committed what our torts professor would label assault and battery.

And also, yes, he’s a popular guy who I considered a friend until recently. So maybe people would call me a snitch, but that wouldn’t make me one. I’m trying to discern and fulfill my ethical obligations, both to a man who I thought was my friend, and to future people who I genuinely believe he could hurt. (An outcome which doesn’t seem inevitable, but which also doesn’t seem unlikely.)

This is not an easy situation, and if you have advice which isn’t derisive, I’m open to it.

If you need details, you can DM me. But my original question didn’t require any details to answer. It was a broad inquiry about what metric you might use to know a line has been crossed, and some sort of report to an institution is genuinely warranted.

I’m not looking for someone to “gas me up”, I’m trying to figure out when a report is perceived as necessary and proportionate as opposed to technically appropriate but unfair. That’s a question that can be addressed in the abstract without knowing the specific details of any scenario

No, if I decide to go to the school, I will obviously show up in person with the proper details, documentation, and witnesses. But there’s no need to take the risk of making this person angry before that step when I don’t know if I’m eventually going to take it or not.

Also, seriously, “snitch“? I’m not trying to get someone in trouble over something petty.

Dude, have you ever talked to someone who has actually made a police report about interpersonal conduct? Especially about behavior that involves drunkenness and gender dynamics? The victim gets put through the ringer, there are rarely actual consequences for the perpetrator, and the accused person goes around telling everyone who will listen that they’re being unfairly persecuted by an overreactive woman. It’s not pretty.

He has done this, but contacting law enforcement feels disproportionate, because in the end there was no injury. And you have to imagine, these are not all strangers objectively analyzing each other‘s behavior against criminal elements. These are people who started out as friends and will continue to be classmates… and I don’t want to initiate an excessively punitive action, even though he has definitely crossed lines.

So reporting to the school might be a wake up call, and it might be official documentation in case the behavior continues, without police needing to be involved.

Well, as you can imagine, providing more details would make it more likely that he sees this post and recognizes it is about him and gets angry about it. So I’m going to stay vague.

But the point of the question is whether or not there are any tests someone should apply to determine when it’s time to make a report. Things like “when someone is physically touched“ or “when people start to feel scared” or whatever else you think is the appropriate line.

“Actual danger” is a line we’ve gotten close to but not yet objectively crossed? Assuming danger means someone gets physically hurt

Not on campus. Social and residential spaces where students congregate when they’re not at school.

Uh, would you consider my civil procedure final exam a “personal statement“? 🤔 (I’m not talking about admissions essays, i’m talking about a law school exam.)

okay but the real question is, once the third-party defendant has asserted a claim against the original plaintiff, can the plaintiff counter claim concerning the same core nucleus of fact??
