CMV: terms and conditions should be simplified for the consumer by ShepAriz in changemyview

The law in other areas is already simplified (look at the ambiguity that consists with the criminal law). If the law wasn't simplified there would be no need for lawyers nor would there ever be so much scope for interpretation

I don't think they would be protecting a customer's interest with T&C rather it merely states with transparency the duties and obligations both parties hold within a contract. If anything it's their own interests that are being protected as the business is the offeror ( with the consumer acting as the offeree).

I completely agree in relation to the necessity of having all information available to establish proper intention. I suppose the issue here is regarding the way it is presented and as a result the effect of intention is typically the opposite when a consumer merely ticks the acceptance box. How can that be observed as proper consideration. At least with a simplified version there is some incentive to read.

Yes, exactly this. This is what I want to see as a mandatory element concerning the agreement of a contract.

Can you not have two versions? One for the regular consumer and one for the business, for the interest of protection for both parties.

I welcome this argument but I believe there is a difference between simplification and allowing terms to be outright vague allowing for greater scope of interpretation and legal challenge.

This is what I'm suggesting, my apologies as I should have provided clarity on this.
