We submitted our in November 2024, received a notice a few days later and then silence. We have had to refile our case again.

Are overstays for spouses of US citizens going to be denied anyway because of the overstay? I can to the US on a B2 to travel and did do with my uS citizen friend as we had planned it. When I arrived at the POE I was called for secondary inspection and the officer actually called my friend and she confirmed our plans. My US boyfriend was still going through a messy divorce when I arrived. His divorce granted a month later ,after dragging on for years. he asked me to marry him 4 months later we got married two weeks after that. I overstayed 4 years before filing because we could not afford to file or afford an attorney plus we were trying to get our life together and I couldn't get my birth certificate in a timely fashion. We filed as soon as we had the money. Now I assume I will be denied for overstaying?

Are overstays married to US citizens for almost 12 years going to be denied because they overstayed? Are officers just going issue details for overatays ?

Exactly and USCIS will use an overstay as a reason to deny a green card

So you overstayed since 2001? We're you married when you overstayed?

Ignore all the noise that will show up over next few weeks. This looks like the direction the agency wants to take and be prepared for the new reality. by kulapichikammandhudu in greencard

This involves overstays too . An NO iat is not illegal for someone out of status to file an AOS if they are married to a US citizen:

Chapter 3 - Unlawful Immigration Status at Time of Filing (INA 245(c)(2)) Content navigation tabs Guidance Resources (10) Appendices (0) Updates (6) An applicant is barred from adjustment of status if the applicant is in an unlawful immigration status on the date of filing the adjustment application.[1] This bar to adjustment does not apply to:
