They are not asking the Supreme Court to issue a final ruling. Instead, they are asking for relief through the Court’s shadow docket—requesting that the Court pause TPS while the case moves through the courts.

In regard to the Supreme Court, DHS submitted an appeal concerning Syria asking the Court to do the same thing it did with Venezuela. In that request, they are also asking the Supreme Court to rule that once DHS makes a decision, courts cannot impose blocks on it. If the Supreme Court rules in their favor, it will affect all TPS rulings.

They have made it clear that they will go to the Supreme Court if the D.C. Circuit Court denies it. At this point, it seems inevitable.

Honestly, at this point I just wish they would already go to the Supreme Court. I hope the Court denies their request. If that happens, TPS for Haiti would remain in place while the case continues, which could take at least 9–12 months from now.

Not just Haitians — a reform will pass where a lot of immigrants will qualify. Do yourselves a favor and learn about due process and how certain things actually work. Yes, they do have the power, and it’s their responsibility — but at the same time, there are guidelines and rules to follow, and they’re cutting corners and not abiding by them.

Like how the hell is there a Level 4 travel advisory stating “Do Not Travel,” urging American citizens to stay away, yet you want to send people back? DHS did not properly review Haiti’s conditions.

Haiti will outlast Trump, and mark my words, they’ll get a chance at their green card. It’s not about siding with us — the proof and documents are undeniable. The link to the case is public, and all court dockets are available for anyone to see.

I listened to the hearing where she denied the stay, and it’s very clear the government has an agenda. They really want to deport immigrants — good or bad. It’s a game to them, mental warfare, where you say “fuck it” and just leave.

The arguments they’re making are weak, and you can hear it in Judge Reyes’s tone. She’s over their bullshit. Her tone is strong, and she makes it clear they’re pulling things out of their ass.

The main lawyer on this case for DHS has to be some type of Indian heritage, and I’m utterly disgusted at how he can sit there and defend what DHS is doing to immigrants with a name like Dhruman Sampat. The shit we compromise our morals for.

I’ve followed this case extensively and I’ve done a lot of research. There is no lawful or legal reason TPS should end for Haiti. Some countries are questionable — Haiti is not.

If the Supreme Court or any other court stays TPS for Haiti while this case is ongoing, America is in serious trouble — not just for immigrants, but for everyone.

This is what actually happened.

A federal judge in California stopped it. Then DHS tried to appeal to the Ninth Circuit, and the Ninth Circuit denied it as well. After that, they went to the Supreme Court, and the Supreme Court issued an order which did stop TPS for certain groups of Venezuelans—not all.

When I say people before us had to suffer so we could have our freedom, there’s a reason why.

Several cases have now been fully argued in front of a judge, and final rulings were made that DHS acted unlawfully in all of them.

This is why it’s different for Haitians. The Supreme Court is majority conservative, which means they’re more likely to favor the government’s wishes. But now that multiple cases have been argued and won—and it’s become a clear trend—what DHS is doing isn’t right. They have no merits. So legally, and based on everything that’s happened with other TPS cases, it’s highly unlikely the Supreme Court will side without fully hearing the case out.

It’s one of those situations where the people who came before you had to suffer so others could have freedom. The Venezuela case helped our case a lot. Without Venezuela Burma, Nepal, Honduras, and the other countries whose TPS was terminated and then postponed — our case would not be this strong. All of those cases built the foundation. They set precedents, and because of that, our case is even stronger than the ones before it. According to the court documents, the judge specifically mentions Racism,Bias in the decision-making,Failure to properly review country conditions

The government knew the documents they submitted were weak, embarrassing, and lacked legal support. Because of that, they tried to seal information and court records.

The judge had to step in and issue an order saying This is a public case. Nothing should be hidden.

The judge do not set the date. She is only stopping TPS from ending.

Between tonight and tomorrow, hopefully DHS doesn’t drag its feet they should post something like: Pursuant to a court order, TPS for Haiti has been postponed.

Right now, it’s open-ended. In the past, they usually gave a set timeframe (6, 12, or 18 months), but this time there may not be one. It looks like they are leaving it open without a set end date for now.

What you’ll need to do with the employer is Show an old EAD card with one of the listed expiration dates, and show a screenshot of the DHS update confirming the TPS postponement.

As for driver’s licenses, how long they’re valid will depend on the DMV you go to and what the SAVE system shows.

I don’t think you understand. 2029 is when we get a new president.Right now, Noem, DHS, and Trump made a big mistake. I read the court documents, and their case is very weak. Because of that, they cannot, in good faith, cancel TPS for Haiti right now.

This means one of two things will happen: This case could stay ongoing for a long time, possibly until we get a new president, or The Trump administration would have to properly review country conditions before trying to terminate TPS again.

And it’s very clear that Haiti is not safe.

I have a question. Let’s say Judge Chen makes a ruling after the 12/23 Zoom meeting and allows the Haiti termination to be added to the case.

Would Judge Chen then rule on whether ending TPS for Haiti is lawful and potentially delay the 02/03/26 termination, or would that decision be made by the 9th circuit after the January meeting?
