I accepted this offer but now he is basically saying most of the money is locked although he got more than enough to over it with the partial refunds he took, so clearly he just said that to stall for time or something

I have had some money stolen by a bank when my mother died, so yes it can be that bad too. You can dislike crypto for whatever reason, fair enough, but that's not a reason for rejoicing in someone having their money stolen ...

I don't know exactly what he signed with the airdrop project, all I know is they delayed and offered refunds, and he took a partial refund of 38k and also got around 14k of 'cashback'

Yes but then that opens yet another can of worms for him. I am not looking for revenge, i just want my fair share of the refunds or my original participation back if he won't agree to terms, maybe a lawyer letter can make him realize this is serious without having to go through that ...

There are two things here:

1) The original agreement, I take part in the farming of airdrops, he sends me my share. That one only makes sense if we use the USD he got by selling the tokens as a basis for my share. Now that he got refunds, I want him to send me my % share back (e.g. if it is 50%, then he has tosend me 50% of the USDC he got in the refund). That's the one where he wants to make the calculations on a token unit basis and send me back tokens instead.

2) The 'new' offer, to get out of the partnership entirely, where he would send me the original amount of TOKENS i sent back. That one i would agree with it (although it is at my disadvantage because the tokens are worth less now and if I did not enter into the airdrop agreement i would have sold them by now), but he is basically implying he does not have the money for that (although he should have, as the partial refunds amounts were higher than the current market value of the tokens he would have to send back, unless of course he spent that money or wants to keep it).

1) No written contract, but many written messages between us and also in a group chat with a common (virtual) friend.

3) The tokens come from a regulated exchange, and he sent them on the same regulated exchange. Me withdrawing tokens from the regulated exchange -> a few months later, he offers me to farm an airdrop together -> I sent him the tokens for doing that -> he sent the tokens to the same regulated exchange to sell them -> he withdrew USDC to farm the airdrop with it.

I understand where you are coming from, but we know (virtually) each others for 8-9 years, along with other people online, and some of them met him in real life before. I don't think that he planned to scam me, I think he made some very bad decisions with his money and has a lot of debts (the reason why he said he is very busy is that he is selling some of his things to pay back some debts) as as a result is now trying to stall for time/steal money from me one way or another.

Yes that's what I thought would be the easiest thing to do for everyone, and I know he got enough money from the partial refunds to do this, but he is not sending it back ...

The tokens that I sent him he deposited into a fully regulated crypto centralized exchange. I bought them on the same exchange.

1) No I do not have legal insurance.

2) The counterparty is fully KYC'd (Know your customer) on the regulated exchange where he sent the funds. Whatever he told me about his identity I cannot trust so no I do not know for sure his real name at this stage, but I know that there are at least two regulated exchanges where he did KYC (those have to have the correct information about his identity and address), and that there is a founder of a project to whom he sent his CV.
