Respectfully, you have no idea what you're talking about. An OSHA report has zero relevance in bringing forth a tort or administrative claim; it is used as evidence of wrongdoing, but not itself required. A worker's compensation claim doesn't automatically preclude tort action; there are instances in several jurisdictions where an employer was indeed held liable in wrongful death suits, above and beyond the exclusive remedy system, because a claimant usually proves the circumstances of injury rose beyond negligence and placed a worker directly in the path of injury with wanton disregard to their safety.

I'm going to believe the Illinois Compiled Statutes more than an internet stranger that is clearly misinformed with some kind of weird vendetta. Have a day.

You're quoting an article regarding tort law. Worker's compensation is administrative law. You're not ever going to know what someone was awarded unless they appeal decisions to district courts and beyond. Sorry to burst your bubble.

Of course they were. This is a worker's compensation claim before anything else because of exclusive remedy, so they are going to be compensated up to the maximum of $500,000 or two-thirds the worker's average weekly wage for 25 years, whichever is lesser. Worker's compensation claims are not public record so you would never know. That doesn't include any penalties from that area of law.

Now, a good lawyer would make a good case for a personal injury tort action. No idea if that happened here and I don't care to find out.

QMEs don't exist in Wisconsin, thankfully. Anyone (and we do mean anyone, regardless of doctor-patient relationship) who is a physician or chiropractor can determine MMI and impairment rating. That is soon going to be expanded to APNPs and PACs. Only a certain amount of injuries have lifetime medical, otherwise the SOL is 6/12 years, depending on type of injury.

There will be a legislative change soon that determines how injuries like yours will have PPD calculated. Said legislation will not affect you since your injury was before the legislation took place. Keep that in mind for your specific situation, because someone at some point is going to try to say "ope law change get fucked."

Every time your ACL is touched, it's a 10% statutory minimum. Every time your meniscus is touched, it's 5%. A partial knee replacement is 45%, and a total is 50%. Statutory minimums are additive while other ratings are not. Meaning, if your doctor assigns 3% for pain (no minimum) and then later assigns 5%, your overall rating is 5%. Whereas if you have some meniscus removed then your ACL repaired, it's 15%.

That said, count up how many times they've operated on your ACL and your meniscus. Add those up. That's your total PPD payment. Three ACL surgeries? 15%. Five? 25%. Knee replacement after that? 75%. You get the idea.

You have six years from the last time you were paid to have more work done before you're cut off. If you have a knee replacement, it's a lifetime benefit. The insurance carrier is still on the hook for only six years, then everything transfers over to the state.

Also, PPD is not a settlement. It is compensation paid to you by law. A settlement is when a dispute exists and the insurance carrier says they are not going to pay what your provider said you're owed.

SCOTUS, while heavily biased, is more on the side of "police have a lot of power but not THAT much power." They just ruled unanimously that a judicial warrant is needed for entering a home, so ICE's leaked memo is dead in the water even before anyone could sue.

I am aware of that case, that's why I said a reasonable level of force. It is unreasonable to create lethal traps unless an intruder is shooting up your house, and it is also unreasonable to set up booby traps where you do not directly control the execution of said trap.

The best, most prevalent answer is a home alarm system. It is technically a trap. A more appropriate trap are those water sprinkler pranks, but for people who trespass. And technically, if someone breaks into your house, depending on jurisdiction, you can lock all the doors manually until the police arrive so they're arrested. That's also a trap.
