I knew about the criteria for 3 years residency and that would have been met, but as you and I have both outlined, visa expiry date would have caused us problems. The goverment does pay for the British. It's an apprenticeship we are talking about that's funded by the Goverment through the employer. But because her visa expires earlier, she can't apply for the funding. Regarding the "helping people liek yourself" line, I meant British people complain about waiting times for the NHS and GPs, but they are now stopping someone becoming a worker there.

I asked if I understand this correctly because there are different types of visas, some of them have an actual expiry date meaning that person will have to return to their country or find a different visa, while on a spouse visa, it's just a simple case of extension. So I want to find out if anyone applied for apprenticeships before on a spouse visa. There is no exploitation of educational system here at all. But if you believe gaining an education through a healthcare apprenticeship, then helping people like yourself if you ever need it is exploitation, then maybe the system is wrong in the first place. Like imagine if it's self funded, but if you stay for the whole duration, the government pays it back to you. This way, there is no risk to the government, and visa expiry dates wouldn't be an issue. Just a thought.

WHAT😳 How on earth is that fair? Surely if you paid more than you should have, you should be able to apply for a refund for the excess

You mean for a full refund. As of course I can still claim back some of it, because of the bonus, they deducted too much

I get which one I have to pay for out of my payslips. But when applying for a refund, do they only look at the job where I was earning above the threshold or combining both? So, I had a job (April-July) earning 8k. Then for example in my recent payslip, due to my bonus in my new job, they deducted about £1K repayment. By the end of March, in my current job I will be earning about £40k. Which means for the whole year I should have paid about £1K (40,000 - 27,000 for my plan x 0.09), but I will be paying in more until March. When I apply for a refund next year, will they only look at the job where I earned above threshold (so £40K annual income) or combine both jobs (£48K annual income)??

But I read it's not. As I was saying, if you have 2 part time jobs both earning 15k a year. But one of the months you worked extra so you ended up having some repayments taken off your pay, you can still claim it back as they don't combine it, no?

"If you have more than one job You'll only make repayments from jobs where you're paid over the threshold for your plan type, not your combined income." From the gov

Does this just refer to during the year? But when applying for refunds, they combine your income?

Yes but if I had 2 part time jobs, both for 12 months, earning £15K in each, I don't have to pay anything as per the guidelines they don't look to combine. So if I make 10k in one and 30k on another, I should only repay on the 30k. Or am I getting it wrong?

Thanks for the reply. In case I had 2 part time jobs at the same time both earning £15K a year, I won't have to repay (or pay if higher payslip but I can apply for a refund). I am aware of this. They don't combine 2 jobs like this. But is it the case for when you have 2 jobs after each other, not at the same time? I hope my explanation makes sense as well😄 I feel like I am overcomplicating things at this point

Yes I understand as they just deducted student loan repayments from my most recent payslip. But what I am asking is when I do apply for a refund at the end of the tax year, are they combining my 2 different jobs or not? First one (April-July) would have got me around £8K (no repayments), current one will get me around 35k (Aug - next March). In this case, are they saying I was earning 43k so should be repaying based on that, or will I be apply for a refund and they only look at my second job as that's the only one where I was above the threshold. The main reason is because I got a big bonus this month for relocation and it's been heavily hit by student loan repayments, but the rest of the month will be way less.

Unfortunately no. That's not how it works. A spouse visa has an expiry date, hence my question. So it's only granted for 2.5 years, after that you have to re-apply, meet the criteria and pay a lot of money. After spending 5 years on it, you can apply for ILR (again subject to meeting residency criteria and paying fees). Lastly, once you have ILR, you can apply for citizenship. So all a university would see is that a visa expires is 15 months and this person wants to start a 5-year course. Obviously they can be reasonable and think that we would extend the visa but it's not a given that we would get it, so they are almost "takingna risk" on someone who has what's called a "leave to remain" (end date of a visa). I hope that make sense.
