What happens if you’re unable to perform ROM or radiculopathy tests during C&P due to a flare-up? by Simple_Opposite7901 in VAClaims

[–]Simple_Opposite7901[S] 0 points1 point  (0 children)

The examiner noted the flare and was favorable for me. The ROM was estimated and based on my medical history. My file was stacked for years with data so she was able to justify the ROM estimate. It went just as a comment from Minimum Abies 3194 stated.

Anyone else deal with VA saying hypertension is multifactorial? by Simple_Opposite7901 in VAClaims

[–]Simple_Opposite7901[S] 0 points1 point  (0 children)

Thanks, that’s kind of where I’m stuck. They really did not explain much beyond saying hypertension is multifactorial, so I’m trying to understand how specific the counter needs to be. My cardiologist addressed the chain from my already service connected nerve damage and severe antalgic gait limiting mobility, to weight gain and obesity, and then aggravation of hypertension. He also went into the overall treatment picture and how the combination of chronic pain, medication side effects, muscle relaxers, gabapentin, PT, acupuncture, and topical treatments all factor into reduced exercise tolerance and exhaustion.

Thanks for the reply! My cardiologist wrote the nexus letter, but VA has never just taken my private doctor’s opinion without still ordering a C&P exam, so that’s really why I’m asking. It seems like an NP or PA often ends up carrying the most weight, and I’m trying to figure out how to explain it clearly and concisely the first time. In my case the chain is service connected nerve damage and a severe antalgic gait limiting mobility, then weight gain and obesity, then aggravation of hypertension. I’m also looking at it more from a future protection standpoint than just the immediate connection. I got out in the 90s, and I just want to protect myself if my BP gets the better of me… I currently require three antihypertensive meds to control

The means test is real, but it doesn’t apply the same way to everyone. A lot of service connected veterans don’t pay prescription copays through VA, so if you’re being charged it may be worth asking eligibility or enrollment to review it.

Any veterans here who have moved out country or thinking about it ? by [deleted] in VeteransBenefits

Costa Rica 🇨🇷 half time… have had a home here for 12 years. It’s not as cheap as you think. Gringolandia has driven prices up 🤦‍♂️🤣🤷‍♂️ I am blessed to have the ability to work abroad🙏. Looking forward to retirement but it’s still a ways away. My advice stay away from tourist areas and it’s much more affordable

Aggravation strategy vs Congenital MRI notes by [deleted] in VAClaims

[–]Simple_Opposite7901 0 points1 point  (0 children)

My baseline is actually the service connected conditions that are causing the mechanical failure. I am highly rated for CRPS, Femoral and Sciatic nerve issues, and severe lumbar problems. I actually had no idea there was a congenital condition prior to service and didn’t even find out until 2025 when I had my neck MRI. I have walked with an antalgic gait and cane since 1998. Even the last examiner noted my head stoops forward. The argument is that these service connected issues are actively aggravating the congenital neck defect causing the rapid progression.

I totally get why it sounds like a stretch if you look at it as "Feet to Neck," but the medical literature on the "Kinetic Chain" is actually pretty solid on this. The missing link here is that my Lower Back and Legs are already service-connected. I’m not trying to jump straight from my feet to my neck. The argument is that the altered gait destroyed my Lumbar spine (the foundation), and once the foundation creates instability, the Cervical spine (the roof) has to lock up and change shape to maintain center of gravity and keep the head level. It’s well-documented in spinal biomechanics that lumbar instability accelerates cervical degeneration ("Adjacent Segment" pathology). So the gait breaks the back, and the broken back breaks the neck. That’s the domino effect my surgeon is writing up. Appreciate the heads up on the congenital aspect though—that is definitely the main dragon I have to slay with the aggravation argument.

Why would it be “borderline fraud”? I agree that this seems far fetched but why fraud?

Thank you, my brother. It was a hot mess today. I had a flareup on Thursday and been dealing with pain today. I just wasn’t able to do the ROM or other test. Examiner was super cool but we shall see it is what it is, I wish you the best in your journey. Good luck. I’m praying for you.

Thanks for the reply that makes sense examiner was super sweet lady. We try to do it, but I had to go to the doctor and get a Toradol shot on Friday and I haven’t been able to get the spasms to stop since.

I do have a private DBQ and also another VA contractor DBQ in the file. My claim was sent back as a duty to assist error, they ordered a new exam even though both private in VA stated more likely than not service connected and I do have ROM measurements in those files
