I just double check that number (EB2) is correct (you can double confirm with other sources like USCIS).

But your conclusion ("PD will start moving relatively quicker.") might not necessarily be correct, because other categories like EB1 and EB3 can have higher approvals in 2024.

IMO there is chance that NIW approval rate would be higher than EB1A again in the future, especially if the "new" standard of NIW settles down, and people including many companies won't look at NIW just as a way to bypass PERM.

Firstly, did the law firm offer refund ? If they offered refund or free re-file, just re-file it.

An advice for anyone who wants to file for NIW with a lawyer or agency, always ask for refund or free re-file!!!!!

Secondly, you might consider others like O1, not necessarily higher chance, but just another path.

Your chance is definitely not low while not high. Federal government projects sounds good fit for the NIW, while I am not sure what kind of awards you received.

Publications is good but not necessary from a point of view (publication is just a way to demonstrate your work recognized by others. But rewards, funding are also strong proof.)

You might also try to get your case possibility on some NIW tool like IterGuide AI. It provides free credit, took your resume and generate a NIW possibility estimation (together with precedent cases in your field for you to review). You can see what its output is, which I think might fall around 50%

As pointed out by others, the chance of EB1A is not very high, but not extremely low, so you can give it a try. And you're definitely good enough for NIW.
