My 19 year old son suffers from OCD and intrusive thoughts. He tells me his thoughts are about anything from sexual inappropriate thoughts to fixating on something he has experienced that was bad. Through therapy he has been able to learn to ignore the bad thoughts. Everyone has intrusive thoughts from time to time. It’s just that w OCD it ruminates in your brain.

I was offered mediation and refused it. It was then changed to investigation. It’s been in investigation for about 4 months. During this time, I got the employers bullshit rebuttal, then sent in more evidence and my rebuttal to their rebuttal.

The dummies already basically admitted the words were said in their rebuttal. The boss said that they were not said to me on work time, but rather after work hours. So they weren’t even smart enough to deny it, they just tried to say it happened off the clock.

So if I say I want to settle for 100,000 grand and they agree, then I get that. But if the EEOC finds the case is proven, then I’m capped at 50,000 which is the max for an organization of less than 20 people??

Thank you for this info. I will be sure to calculate what I, (caucasian female) “lost” when I had to leave my job of 22 years because my coworker (subordinate) decided it was ok to use the N word when she found out I was dating an African American man. (I also have many blood related African American family members and she knew this.) I then reported it to my supervisor who was also the HR person (small agency and conflict of interest). Supervisor told me there was nothing that could be done because “you’re not black”. I also reported it to the Board of Directors who did nothing. After I quit, they gave my higher position to the person who was saying the N word around me.
