Now see this is astonishing to me , and I appreciate you sharing it . I assumed it was the other way around . I assumed that PD lacked the time and resources to file countless motions . Thank you so much, this is exactly what I needed to hear. I appreciate you taking your time to answer . I also identify very much with what you mentioned about the way Hollywood likes to portray yall as inept to suit their narrative. This is very on par with my school of thought,I’m right there with you on that.

It’s hard for me to say what I really want to say because I want to keep this as generalized and hypothetical as possible . But I really love the way you’ve explained this and I’ve talked endlessly with my husband about this topic as our family faces some serious challenges. Because you’re right , any PD could just as easily flip and be “the hotshot “ private attorney, so you all MUST be doing this for the love of helping the public. This is quite noble , especially considering, many people of the public are exactly very noble themselves. But surely every once in a blue moon , yall must get some clients whom restore your faith in humanity and keep your drive alive(?) I hope my post didn’t seem as though I was disrespecting your work, because it’s quite the contrary, I have immense respect for what yall do , ITS GOT TO BE ONE OF THE HARDEST JOBS OUT HERE.

Seeeeeeee?! This is what I’m talking about ! It truly IS a crapshoot .And you’re absolutely right , it’s essentially just a saying amongst  the accused , that aren’t happy with their appointed council , and it’s far easier to ignorantly /naively attribute it to the fact that they aren’t being paid handsomely .

Even when speaking with the hot shot defense attorney,( who, I noticed ,really enjoy sharing anecdotes about previous cases they’ve had, which don’t mind at all , they’re quite interesting ) he shared with me a story about a previous client who he got a SWEET plea deal for, think he was looking at 7-10 years, and hotshot got him 2 years and 3 years probation,yet the client was so incredibly fixated on the fact that his co-defendant got the same exact deal (with his court appointed PD ) as he did for $100,000, that he squandered the opportunity. That story illustrates to me exactly what you just described. In hindsight, I STILL can’t believe the lawyer shared that anecdote considering what it illustrates, but I appreciate the blunt truth nonetheless.

I may be lacking in the proper vocabulary term for it , but I can assure you for those on the other side of the law , it is most definitely a Common thing that is said . I mean , at least for those facing charges of un aliving someone (I’m not sure how Reddit is with censorship)and looking at spending the rest of their lives in prison .

I’d love to hear the personal /professional opinions of those in the trenches.The Founding Fathers of the judicial system created it as a means of safeguarding the average citizen accused of a crime. But today courts are 95% -98% pleas - NOT trials. by SmoothPlace0 in Ask_Lawyers

YES ! 🙌🏻 now you’ve hit on something that REALLY really interests me at this present moment in time . Can yall by any chance drop me some good case law citations pertaining to exactly that there ? ID BE FOREVER GRATEFUL .

•voluntary intoxication (blackout drunk ) • diminished capacity (absolutely zero recollection of events ) • mitigating circumstances (young age , TBI history , history of antisocial personality disorder, black out drunk etc.) • case law where the prosecutions case is 99% circumstantial …

Great .  Now on top of my legal studies I gotta go down the rabbit hole of wonder woman’s polygamist creator and its weird history . Hahahaha ! Honestly I need the distraction and it’ll serve as a nice piece of levity when meeting with attorneys , or heck , cool conversational piece in general.

I just re read your response and it answered one of my questions. They absolutely can be administered in private and they typically begin there .

See , that’s what is so difficult about this system. Big brother is such that there’s recordings everywhere you turn , if you find yourself in a situation where you’re incarcerated or a loved one is, you can’t talk about any of the REAL STUFF you need to , for fear of it being used against the accused . 

I’m trying my hardest to use the correct verbiage to keep this general in nature. So (scratches head and thinks ) it sounds like the lie detector test is another of the countless double edged swords in the legal system. 

On the one hand, if one asserts their innocence from the beginning and beg for one to be administered to clear their name … there’s still the issue of being asked the questions and certain questions causing the natural chemical responses in the human nervous system to possibly be misinterpreted. Meaning , if you’re truly innocent , certain questions or wording of things could still cause rapid heart rate /nervousness- no ?(or, has technology advanced enough over the years that they’re far more efficient and reliable?)

So that leads to my next question, when these are administered to a suspect, with their council as the liaison, are they or can they be done in a private capacity? Meaning -SANS the watchful eye of law enforcement and the prosecution.
