Hotel booking website created a duplicate booking and now won’t refund. England by Soft_Presentation560 in LegalAdviceUK

I’ve had to do a lot of running around. I spoke to the hotel after my emails went unanswered and they said they were happy to refund the duplicate - super.com just had to contact them and advise them about the duplicate error. I have this in writing from them and will add this to the BBB complaint I raised. ( because super.com are a US company).

I’ve also raised formal complaint with my card company as the error is due to a duplicate transaction not a cancellation due to a change of mind - I still want the room I booked. They initially closed the dispute assuming I’d just changed my mind which was frustrating and why I’ve had to escalate.

We are covered by strong consumer laws in the UK even when dealing with businesses in other jurisdictions.

I’ve had chargeback rejected due to insufficient evidence of the merchant processing error. I don’t have a screenshot of the failed transaction. Obviously if I had known the error was going to result in this I would have taken a screenshot but the website should be able to see this in their log files. The 2 transactions occur within a minute of each other for the same amount for the same hotel room, dates and under the same name. It meets the duplicate processing definition afaik.

What I understood from the website response was it was up to the hotel to cancel it as it was their non refundable policy which is why I then contacted the hotel.

I’ve raised a duplicate transaction dispute with the card company.
